HIMACHAL PRADESH SCHOLARSHIP SCAM, RELATED TO DISBURSAL OF SCHOLARSHIPS, BY THE DIRECTORATE OF HIGHER EDUCATION, MONITORED BY THE HIGH COURT, UNDER PMLA, HAS BEEN CONCLUDED BY THE CBI, FILES CHARGES AGAINST 20 EDUCATIONAL INSTITUTES.

The Scholarship scam of the department of education Himachal Pradesh has been concluded by the CBI and has filed chargesheets against the twenty institutions and 105 persons, including the owners of the said institutions, personnel from the Directorate of the higher education, bank officials and the other private persons . During the course of investigations, 19 persons including employees of the Directorate of the higher education, Shimla and chair persons, vice chair persons, director, employees of the educational institutes and the bank officials were arrested. The CBI is taking cognisance of the matter since 2019 and booked private educational institutions of the state of Himachal Pradesh for fake and fraudulent claims of scholarship around 181 crores. There after the Himachal Pradesh High court monitored the investigations and status reports were filed accordingly. The case pertains to the misuse of the scholarship scheme/reimbursement of fees launched by the center and implemented across the state government to help the students of the SC/ST/OBC categories. Based on the CBI's FIR the ED also investigated disbursal of scholarships by the Himachal Pradesh directorate of higher education. Last year the ED had raided, 24 locations in Himachal Pradesh, Punjab, Haryana and Delhi under PMLA and taking cognisance in the matter.

ENJOYED JOURNEY TO MATA VASHNO DEVI JI TEMPLE ON 26-3-2024 TO 28-3-2024, WITH FAMILY FOR THE WELFARE OF SOUL AND PILGRIMS LAND

It was an occasion of visit to Mata Vashno Devi Bhawan situated in Jammu &Kashmir for three days touring on the programme of place regarded as holy divinity by the members of various Associations of the living human where in my family members were also present on the occasion of this touring. From the Railway station Katra to stay in the Hotel Vaishnavi, where we have stayed for two days on 26-3-2024 &27-3-2024 our journey had been started and accomplished as a pilgrim and there after it was an on foot journey right from Tarakote to Adkwari and then to Vashno Devi bhawan at top of the hills from where it was through the ropeway carrier for Bhairon temple of the place of wisdom for the pilgrims of the holy place of journey to enjoy the heritage culture of our society and circle calling all the way "Jai Mata di" -"Jai Mata di".After taking the physical darshan of Mata Vashno Devi's pandi at top of the hill about twelve kilometre from the Tarakote we came back to the Hotel vaishnavi on foot and enjoyed this journey with the masses where many more people are visiting this holy place for the soul satisfaction and heritage culture dignity and divinity presence of their human body before the Mata Vashno Devi, where people are visiting for their wisdom of celebration. We have also passed forty two metres of cave for the darshan of pindi of Mata Vashno Devi ji with thousands of other people enjoying the darshan of Mata Vashno Devi ji at top of hill where the Bhawan of Mata Vashno Devi ji maintained by the department of administration in Jammu &Kashmir for the welfare of the pilgrims of the place regarded as the holy divinity of the heritage culture of our society and circle , and enjoying this celebration of the on foot journey, where some people are also going through horse trading and by air as well as as electric vehicles for some distance but it is difficult to get it reserved for the individuals as there is no availability of the such facilities in general and people are facing problems due to routine practice of the facilitation for the common people for which the government of the Jammu &Kashmir is responsible to arrange for the such corridor of the more facilities and too improve the road widening of the existing road of Mara Vashno Devi Bhawan, where it still very narrow and required to be widened, in the interest of general public facing problem of stone fall from the top of the hills and may face accidental access to the journey on foot :-- Er Fateh Chand Guleria, Director , RTI, Welfare Association, Registered number HPCD -3552 , Bilaspur Himachal Pradesh, phone number, 9459334377 .

SOCIAL AUDIT OF THE SCHEMES AND WORK MUST HAVE EFFECTIVE TRANSPARENCY OF THE VISION RTI, REQUIRED FOR THE ACCURACY AND CORRECTNESS OF AIM AND OBJECTIVE OF THE SOCIAL SECURITY BY COMMUNITY PEOPLE DEMANDING FREE AND FAIR JUSTICE FROM THE SYSTEM.

Social audit is a tool for effective transparency and accountability required to achieve the objective of the good governance and charter of the public accountability, found necessary in the implementation of a programme or a scheme . As such it is a concept process of comprehensive complex and the understanding by way of gaining knowledge and required information on the various aspects of the scheme and the programme as well as rights and the entitlements and objective of ensuring introduced poverty, for which the role of the Social auditor is very important in the success of vision eradicate corruption from the system and the social audit is a special process that has been incorporated in the provision of RTI. As such it is necessary at the level of works where social audit is to be carried out regarding to verify the facts and figures of the scheme and obtain the documentary evidences for which Application must be filed under the right to information Act and all the official records pertaining to the implementation of the scheme and the programme so that its important aspects and points must be noted. RTI has attained a vital role of the creation of demand under public utilities for which our Member of the Parliaments and too the State legislative Assembly are taking cognisance of their demands before the house for observation and decision to be taken by the appropriate government. On the similar pattern of required demand under public utilities the RTI activists, volunteers and the Resource persons may also take cognisance of the demand under public utilities and ask for the necessary follow up action with the provision made under RTS act adjudication, list by way and virtue of which social audit of the schemes and programmes of the government works may be created for the awareness of the public authorities as such at present many works are delayed and kept pending in various departments for which the RTI is a good alternative to get information of the delays and dereliction of duty by the concerned department and there after demand under public utilities may be created before the competent higher authority for taking cognisance of the incomplete work and do the needful under provision made and a report should be prepared incorporating the views of the people in comparison to the estimated approvals sought and shortcomings pointed for the irregularities observed which must be given in written to the all concerned for the rectification and completion of the demand under public utilities. As such the RTI welfare Association Registered number HPCD -3552 Bilaspur Himachal Pradesh working for the social audit of various schemes and programmes of the government and taking such irregularities before the competent higher authority for doing needful so required in the aim and objective of the government entitlement issued for the welfare of the community people demanding implementation of the schemes targetted with the time limits prescribed by the administrative approval of the scheme and work for public utilities, however remaining pending because of the various problems of the department and it becomes necessary for the RTI activists and volunteers as well as the working NGOs to initiate the creation for completion and corrective measures after obtaining the information from the public authorities concerned. In this regard it is particularly mentioned here that many minor works in the rural areas are pending because of the pertinent delays and it is necessary to highlight the issues and matter before the department in the interest of demand under public utilities, so that wasteful expenditure of the government funding may be fruitful after obtaining the completion certificate from the construction agency or the department concerned.

A MEMBER OTHER THAN MINISTER IS CONSIDERED A PRIVATE MEMBER OF THE HOUSE OF LEGISLATIVE ASSEMBLY OR THE PARLIAMENT

A private member wishing to move a resolution has to give not less than ten days notice with a copy of the resolution and in case the Government desires to move a resolution it shall give seven days notice along with a copy of the resolution. The Speaker can allow a shorter notice. The resolution should relate to a matter of general public interest. The detailed procedure for notice, admissibility, restrictions, withdrawal, amendment, speeches etc may be verified in Rules 96 to 112.As per directions by the Speaker under the Rules of procedure and conduct of business in the Legislative Assembly, a Copy of every Government resolution which has been passed by the House shall be forwarded to the Minister concerned and the concerned Minister shall ensure with in three months time action by the Government on the Resolution passed by the House. A member other than Minister is considered a non -government member of the house for which detailed procedure for notice, admissibility, restrictions, withdrawal, amendment, speeches etc are given in Rules 96 to 112.

As such law of limitations must have adequate consideration for the both ways and it is necessary to assess as to how much more the consumers can pay for milk without it causing demand destruction. If farmers incomes are to be raised without shrinking domestic demand and eroding the global competitiveness of the Indian diary industry, the only solution is to reduce the cost of milk production and how it may be achieved to boost milk yield per animal through genetic improvement and new breeding technologies. As for as other consideration of the challenges required for this production it is impossible to come down heavily on the increase however normal breeding route, whether natural or via artificial insemination would result in good for future probability and five to seven times every third artificial insemination may bring fifty percent of these female, however with the use of sex sorted semen there is a ninety percent probability of only female calves being born. The government is responsible to consider price rise of the essential commodities and extension of the food grain subsidy to various classes of the citizens of country , as such it is not correct to say that there is no impact of the food subsidy on the financial exchequer of the deficit fiscal target, as compared to the challenge of the price rise in the global crude oil prices. The extension of the free ration scheme is benefitting more than half of the population of the country and for which the government is paying financial aid and help to the farmers required to improve their financial status and position of their work and technology. To work on the higher post of super selection issued to junior Engineer after 18 years of the regular service in scale and grade of post is/was a fundamental right of the cadre /post as per classification of post EAE prefixed with the revised norms wef 3-10-1991 with designated post to attain higher /highest position of the cadre with in the schedule for promotion in quota promotion and it was an administrative matter to decide the issue and matter without any adverse effects assigned under a specific order of the Government to senior government employees instead of creating adverse position against the norms of the classified seniority of the cadre /post.The department of HP finance has again issued clarification for not to withheld/stop increments of the senior government employees working in the channel of promotion as getting no promotion with in the time prescribed for the two promotional avenues in the cadre /post however department of the HPPWD taking no cognisance of the instructions and guidelines issued by the advisory departments , time to time issued in this behalf for the settlement of cases preferred by the cadre /grade under Assured Career progression Scheme working for the all employees, where found necessary under the provision made and created for the service benefits of an employees to prove it a super section of the cadre /post and work on the captioned subject matter deliberation required to be processed with procedure in the second channel of promotion being fundamental right of the senior government employees to have two promotional avenues in the service span which is required to be protected by the law code manual prefixed by the Constitution of India in this behalf, in semblance to the position and promotion of others working in the joint cadre with other senior and junior established classification of the posts getting their due benefits as per the provision made and created for the welfare of the general categories of the posts. MAKING FUTURE RTI AND RTS ACTIVISTS AND VOLUNTEERS THROUGH ONLINE WORKSHOP AND TRAINING PROGRAMS MORE MATERIALISED AND VALUABLE.

Online RTI and the RTS act empowerment of citizens of country working for the welfare of society and circle becoming a personality development programme for the new era entrants joining the online meetings and events where exposure to state and the National level campaign regularly working on the captioned subject of training and workshop seminars and the ongoing conferences scheduled for the improvement and ensuring valuable guidelines to the RTI activists and volunteers taking interest for the research and lecture required for the dedicated preparation of Appeals and arguments before the FAA and SIC or CIC. STATE GOVERNMENTS ARE RESPONSIBLE TO FOLLOW MGNREGA DIVISION INSTRUCTIONS OF THE GOVERNMENT OF INDIA, INSTEAD OF ANY CHANGES TO CONVERT ITS SCHEDULE OF RURAL EMPLOYMENT GUARANTEE.

The instructions issued by the Government of India Ministry of rural development MGNREGA division, Krishi Bhawan New Delhi memo dated 11-1-2022 are not followed by the State Government of Himachal pradesh and the Schemes and projects approved by the department of Panchayati Raj institutions are kept pending for implementation as per instructions of the schedule for construction of works in terms of cost alloted to Gram Panchayats for its implementation and paid to the needful community people, demanding their employment from the panchayati Raj institutions where the Mahatma Gandhi National rural employment generation schemes are otherwise constructed through the contract instead of the manpower which is highly objection matter of fact and concern to be noticed by the Government of India and the state government responsible for the employment to poor people demanding their rights and facilities, due to them since the MGNREGA. A THREE MEMBERS APPELLATE AUTHORITY MAY CONSIDER REPRESENTATION OF THE COMPLAINANT AGAINST THE AWARD GIVEN BY THE OMBUDSMAN, LOCATED IN THE OFFICE OF THE NODAL DEPARTMENT (MGNREGA) .

MINUTES OF MEETING (ONLINE WITH NATIONAL CAMPAIGN COMMITTEE ON 3-3-2024:-- Today on 3-3-2024 online meeting scheduled by the National campaign committee was attended by the RTI welfare group registered number HPCD-3552 HP which was attended by Er FC. Guleria, in addition to the other members of Chamba zone Shri Pyar Muhammed and Shri Uttam Chand Vashishtha along with the National representatives of the working committee for promotion of the RTI act adjudication. Shri Pyar Muhammed raised the issue of MANRESA where in he further stated in the house for discussion (online) meeting held and convened for the new era entrants joining the event for resolving their issues and problems. As for as the question of MGNREGS related to HP was raised it is too revealed by the State body members Shri Pyar Muhammed and Shri Uttam chand vashishtha that at present there is no ombudsman in the Chamba district of HP however the cases are being referred to the said office of the Ombudsman which is not correct and justified under the provision made and created for the welfare of community people demanding their genuine rights and eligibility from the government corridor however delayed because of the such linking for conclusive decision of the pending cases at district levels administration. As for as the work and conduct of the ombudsman is concerned , he will sent copy of award to complainant, the MGNREGS authorities against the DPC and state government shall set up a three member appellate authority, consisting of an academician, a retired civil servant and a civil society representative, to consider representation by any party aggrieved by the awards of the ombudsman, such a representation shall be disposed of with in a period of two months by the appellate authority. Office of the appellate authority shall be located in the office of the nodal department of the state government implementing MGNREGA, Expenses of the said appellate authority shall be borne by state from the six percent administrative expenditure permitted under section 22(1) (c) of the MGNREGA.

PRINCIPLE DEPARTMENT OF I&PH IN HIMACHAL PRADESH TAKING NO COGNISANCE OF THE IRC PRECOMMENDATIONS AND FAILED TO SUPPLY A DETAILED DRAWING OF THE ESTIMATE FOR CHANNELISATION OF NALLAH AND IS A MATTER OF CONCERN .

RTI information was demanded from the office of the PIO cum Executive Engineer I&PH division Jhandutta district Bilaspur Himachal pradesh on 27-9-2023 where in partly information received from the PIO vide his number 12134 dated 16-10-2023 however Appeal so preferred before the FAA cum Superintending Engineer I&PH Bilaspur was decided vide number 5952-53 dated7-11-22 to issue complete information to the applicant on captioned subject matter deliberation required to be verified under code and specifications, so related to the work awarded to contractor pertinent to channelisation of a Nallah near water treatment scheme of Malari Balhseena RD 0/0to 23/0 for which copy of the pertinent drawing was also demanded by the applicant from the PIO cum Executive Engineer as per para -3 of the RTI application dated 27-9-2023 but it is regretted to point that no drawing was issued to applicant by the PIO even clear vision of drawing asked for information is proof and evidence on the record of the PIO as well as the FAA more over the department is responsible to follow drawing and design parameters of the scheme or work to be taken in hand by the department/contractor, in addition to the detailed drawings as required on the suitable scales however rough site plan sketch was provided to the applicant instead of the designed drawing for the proposed work of channelisation of Nallah . From the above information of the PIO cum Executive Engineer I&PH Jhandutta District Bilaspur Himachal pradesh it is very clear that no drawing was prepared with design for the construction of said channelisation of Nallah and no cement consumption register was maintained by the department at site of work for regular consumption and check up of the authorities for accuracy of the work.
