CLASSIFICATION OF POSTS ASSIGNED UNDER A SPECIFIC OR SPECIAL ORDER OF THE GOVERNMENT IS A FUNDAMENTAL RIGHT OF CADRE/POST TO HAVE SUPER SELECTION WITH IN THE QUOTA PROMOTION.

To work on the higher post of super selection issued to junior Engineer after 18 years of the regular service in scale and grade of post is/was a fundamental right of the cadre /post as per classification of post EAE prefixed with the revised norms wef 3-10-1991 with designated post to attain higher /highest position of the cadre with in the schedule for promotion in quota promotion and it was an administrative matter to decide the issue and matter without any adverse effects assigned under a specific order of the Government to senior government employees instead of creating adverse position against the norms of the classified seniority of the cadre /post.The department of HP finance has again issued clarification for not to withheld/stop increments of the senior government employees working in the channel of promotion as getting no promotion with in the time prescribed for the two promotional avenues in the cadre /post however department of the HPPWD taking no cognisance of the instructions and guidelines issued by the advisory departments , time to time issued in this behalf for the settlement of cases preferred by the cadre /grade under Assured Career progression Scheme working for the all employees, where found necessary under the provision made and created for the service benefits of an employees to prove it a super section of the cadre /post and work on the captioned subject matter deliberation required to be processed with procedure in the second channel of promotion being fundamental right of the senior government employees to have two promotional avenues in the service span which is required to be protected by the law code manual prefixed by the Constitution of India in this behalf, in semblance to the position and promotion of others working in the joint cadre with other senior and junior established classification of the posts getting their due benefits as per the provision made and created for the welfare of the general categories of the posts. As such it is the duty and responsibility of the department of HPPWD to take final review of the pay commission recommendations so issued by the department of HP finance on 3-1-2022 and decide former cases of the super selection in the cadre and eligible with in the quota promotion for due benefits being senior than other junior cadres working in the joint seniority of higher/highest Recruitment and the promotion rules. The said seniority of the cadre /post exists with in the system of classification, character and status of posts and for which the cases already sent to the Head of the department vo se number 16681-82 dated 27-3-2005 and there is no reason to unnecessary delay and deny review and revision of the posts referred by the government and department of HPPWD vide number PBW -A-B(1) -3/2015-L dated 31-1-2024 and addressed to the HOD for correction as per instructions of the department of Finance and personnel being final authority to decide former cases of the ACPS, so preferred in the second channel of promotion by the individual being senior than the draft man too promoted AEEs in the joint cadre during the period of 1-1-1986 onwards to 1-1-1996 more so next classification of junior Engineer issued for ACPS on 4-8-2001 with class -11 status of post and designation Additional Assistant Engineer which is accordingly furnished for implementation on 3-1-2022 by the department of HP finance being responsible to follow norms for the eligibility and claims by the senior government employees facing deep long prevailed stagnation in the post and demanding fundamental rights of the super selection and classification of the post.:-- Er Fateh Chand Guleria, Director RTI Welfare Association registered number HPCD 3552 Bilaspur Himachal pradesh, phone, 9459334377.
