REASON BEHIND THE (SIR) SHOULD BE EXAMINED IN VIEW OF THE DIFFICULTIES, BEING FACED BY THE PUBLIC

Opposition leaders of Maharashtra, Bengal and Bihar etc demanding cancellation of the special intensive revision (SIR) of electoral rolls and protesting against the Central Election Commission, where in the main opposition party and the leader of the opposition Shri Rahul Gandhi along with other party leaders and the workers are also playing an important role for this review and examination of the (SIR) where in it is revealed that more than thirteen crores of voters have been wrongly denied for their voting rights, because of the said processing for the special intensive revision (SIR) by (CEC) and it is blamed against the criminal conspiracy and vote theft charges by the opposite front through out the country. All political parties are almost United on the captioned subject matter deliberations required to be verified by the appropriate authorities and the Honourable Supreme Court of India, also taking cognisance of the such big numbers of the voters exclusion. More than five percent of such enumeration of the voting right , definitely creating a doubt of the criminal conspiracy by the working people and directions on the arbitrary decision making at the levels of the appropriate authorities, working on the captioned subject matter deliberations required to be decided by way the natural justice and open Government law and the justice for the people denied their fundamental rights by way of such exercise where crores of the voters have been removed from the existing rolls and it is becoming necessary to verify the facts placed on the records by the decision making authorities right from the lower level of the work and conduct to highest levels of the CEC, as such the matter is a very serious, if such wrong decision making has been enforced by way of wrong doing and without going into the verification of records, maintained by the open Government Law, working for good governance and accountability under law code manuals prefixed by the Constitution of India in this behalf:-- Er Fateh chand Guleria, Director RTI welfare Association registered number HPCD, 3552 , Bilaspur Himachal pradesh phone number, 9459334377

NEED FOR SPEEDY DISPOSAL OF CASES/WORK HAS BEEN SUGGESTED BY THE TIME LIMIT FOR DISPOSAL AND IT IS TOO NECESSARY TO HAVE MONTHLY STATEMENT OF CASES, FINALIZATION OVER-3 MONTHS, AT THE LEVELS OF HODs AND ALSO BY THE REGISTRAR SIC, AS SIC IS IN DEFUNCT STATUS AND POSITION, SINCE VERY LONG

Need for speedy disposal of work has been prescribed under efficiency in administration and procedure and methods for disposal of timely action, the purpose for which these have been evolved otherwise it would be defeated if these procedures are reduced to mere red -tape and delays occur in the disposal of work and references containing information, instructions or decisions and it should be realised that the administrative delays are a source of discontent and delay breeds corruption, and effective implementation of Government policies and programmes largely depends upon an efficient and speedy disposal of the work. It is particularly mentioned here that the need for speedy disposal of work decided with the timelines for the disposal of cases has no follow up, even in the cases of Right to Information Act, 2005 no pendency is being noticed by the public information officers and also by the First Appellate Authorities and cases pending over three months from the month that the receipt of the original reference, no review of complaints noticed by the FAAs and also by the Registrar of the State Information Commission and on the other hand the HOD taking no cognisant of the statements pending finalization over three months, required to be informed to the Honourable Chief Minister through the Chief Secretary of the state, but it is regretted for the required compliance, even the department of Administrative reforms taking cognisance of the complaints and representations in the absence of the SIC and SCIC, list by way and virtue of which it is essential for the HODs to taking a stock of the all pending undecided work, and have monitoring progress and reporting to the Head of the Department/office.The main responsibility will, however, rest with the decision taking authority and it will be for him to pass final orders, instead of unnecessary pendency on the captioned subject matter deliberation required to be decided on the basis of time limits to be reckoned from the date of the receipt of the first original reference mentioned on the file submitted and also noticed by the Reminder Diary :-- Er Fateh chand Guleria, Director RTI welfare Association registered number HPCD, 3552 , Bilaspur Himachal pradesh phone number, 9459334377

GOVERNMENT FUNCTIONING MUST BE REGULATED BY VARIOUS PROVISIONS OF THE CONSTITUTION , AND ACTS AND RULES FRAMED THEREUNDER, AND JUSTICE BE GIVEN TO THE COMMON MAN

" Samvidhan hai Bhagwan aur Inshan ka Nagahwan" :---
Government functioning is regulated by various provisions of the Constitution of India and the Acts and Rules framed thereunder, where public servants, including the government servants are accountable for their official actions. Of course there are different levels of accountability dischargable at different levels. In the administrative hierarchy, it is essential to set out in advance this accountability, so that this responsibility at different levels must be known and reasonable discretion and freedom of action is also established within well defined limits, where the law code manual setting with procedures laid and standards, working in order to establish accountability at all levels of the Government functioning may be protected under the provision made by Constitution, required to exercise his discretion. Article 19(1) of the Constitution of India provides that all citizens shall have the right to freedom of speech and expression. The proviso to Article 309 of the Constitution provides for rules regulating the recruitment and conditions of service of persons appointed to the Government services and posts. Accordingly the rights provided in Article 19(1) of the Constitution are also subject to reasonable restrictions, if any, imposed under the rules framed under proviso to Article 309 of the Constitution, in so far as the Government servants are concerned. Various rules have been framed under proviso to Article 309 and some of the provisions of such rules which impose reasonable restrictions under the fundamental rules:-- Er Fateh Chand Guleria, Director RTI welfare Association registered number HPCD, 3552 , Bilaspur Himachal pradesh phone number, 9459334377

HUMAN BIRTH IS A RARE AND A PRECIOUS BLESSING OF THE ALMIGHTY GOD, LIVING IN THE SOUL OF EVERY SERVICE FOR OTHERS AND TOO FOR OURSELVES.

Human birth is a rare and a precious blessing of the Almighty God for the individual soul to realise its true nature and devastation at the heart of land and devotion to the human service under need for the living centre of faith and depending upon the man made stories instead of the present service for the society and circle, still demanding help from the human being, but how to put this divine path on the practical regime  is also a problem of the masses, where our services are misused by the others on the name of devotion and heritage and definitely it must be subject of discussion and renewed faith on the experience obtained from the past and future of our service to the living centre of faith, drawing large number of devotees for service, however the story remaining altogether a different vision of the truth of life and liberty, except for the drawing comparison supported by imagination for the truth of every blessing, forgiving people and seeking forgiveness, by way of quality and culture for the respect of each other living in the society and circle, where expectations may become acceptance of all souls reminding us to bring politeness and sweetness into our words, tone and interactions, required for the every humen being under deep human connection of soul and the transformation working on behalf of the humankind relationship with the Almighty God always living in the soul of service for others and becoming an energiser for others and too for ourselves, but it is a rare understanding :-- Er Fateh chand Guleria, Director RTI welfare Association registered number HPCD, 3552 , Bilaspur Himachal pradesh phone number, 9459334377

ARTISTIC FREEDOM IS ESSENTIAL FOR DEMOCRATIC SOCIETY AND ORGANIZATIONS, IT IS ALSO NECESSARY TO TOLERATE FREEDOM OF SPEECH AND EXPRESSION, MANDATORY FOR ALL IN THE DEMOCRACY WORKING FOR GOOD GOVERNANCE AND ACCOUNTABILITY

Article 19(1) of the Constitution of India provides that all citizens shall have the right to freedom of speech and expression;to assemble peaceably and without arms; to form Associations or unions;to move freely throughout the territory of India;to reside and settle in any part of the territory of India;and to practice and profession or to carry on any profession, trade or business. Clauses (2) to (6) of Article 19 , however, provide for the operation of existing laws and empowers the state Government to make any law imposing reasonable restrictions in the interest of sovereignty and integrity of India or public order or morality etc, on the exercise of these rights. The term "Law" or usage having the force of Law. International human rights law Codifies this Millian absolutism. Article 19 of the international covenant on civil and political rights protects freedom of expression regardless of frontiers and in the form of art. The UN Human rights Committee declared that blasphemy laws are incompatible with the covenant, unless they qualify as incitement. The European Court of Human Rights similarly protects expression that"offends shocks or disturbs " , affirming that artistic freedom is " Essential for the democratic society " The Venice Commission called for abolishing all blasphemy laws. Yet critics questioned whether freedom of expression exists isolated from the power dynamics? Free societies must tolerate freedom of speech and expression, being this absolute democratic necessity and work for the democratic rights and protections of the fundamental rights under law code manual prefixed by the Constitution of India in this behalf failing which people may not get their empowerment under the equity and equation for all in the same room of society and circle and demanding good government and charter of public accountability for which the political parties are doing needful and responsible for the good governance and accountability:-- Er Fateh chand Guleria, Director RTI welfare Association registered number HPCD, 3552 , Bilaspur Himachal Pradesh phone number 9459334377

IN ADDITION TO PARLIAMENTARY DEMOCRACY OF COUNTRY THE CIVIL SOCIETIES AND THE SYSTEM FOR JUSTICE MAINTAINED BY JUDICIARY, CONTROL OF PUBLIC AUTHORITIES ALSO WORKING FOR THE VIRTUES OF TRANSPARENCY AND OPEN GOVERNMENT AND RTI LAW.

It seems political parties are working for developing a political influence rather than greater transparency and accountability, good governance and solutions to persistent social and economic problems. The political system and the political culture reducing the factor of probability for stable position and dignity for the provision made and required for the redressal of grievances through mechanism under cooperative public posture, while protecting the influence of the posts and caliber required for the welfare of people of country, where it is necessary to get it done through administrative reforms organisation and access to information under the Right to Information Act, 2005 . As such the opposition parties and the Right to information activists and volunteers also playing an important role in the day to day work of citizens charters related to their representations for the adopted changes and replacing them under the provision made for resolving problems that have accumulated over years but no decision making on the captioned subject matter deliberations required to be decided by the understanding of each other becoming a problem for the common agenda and confrontation among each other, list by way and virtue of which general public facing problems, however the political parties are taking no cognisance to come on the conclusion, required for the democracy of our country in the interest of demand for the change under administrative reforms and fighting for the power platform through agitation and the walk outs from the Loksabha and the Rajyasabha as well as the State Assemblies, that is against the true democracy norms of society and communities, ultimately working for the welfare of people of country and there is no reason to follow delay and dereliction of duty and Act against the norms of the DoP&T as well as the Honourable Supreme Court of India, better equipped to keep necessary vigil on the instruments of governance and make the Government more accountable to the governed, where the RTI Act has also created a practical regime through which the citizens of the country may have access to information under the control of the public authorities:-- Er Fateh chand Guleria, Director RTI welfare Association registered number HPCD, 3552 , Bilaspur Himachal pradesh phone number, 9459334377
