STATE INFORMATION COMMISSION IDLE, BECAUSE OF NO SIC AND SCIC IN THE POWERS, VESTED IN A CIVIL COURT WHILE TRYING A SUIT UNDER, THE CODE OF CIVIL PROCEDURE, 1908.
Appropriate government failed to appoint SIC and the SCIC in State Information Commission for last about one year and the people facing problems because of non compliance at the levels of SIC, found necessary for complaints and the second Appeal, list by way and virtue of which the objective of the Right to Information Act, 2005 becoming un effective and an elaborate institutional mechanism has been destroyed by the functioning of the government taking no cognisance of the section 19(6) of the Right to Information Act, working for the timely action and correction as required for decision making, under the RTI Act, as a quasi judical function, where in it is found necessary that the appellate authority should see to it that the justice is not only done but it should also appear to have been done. In order to do so, the order passed by the appellate authority should be a speaking order giving justification for the decision arrived at. It is particularly mentioned here that the SIC is in defunct status and position since long and the public Information officers are taking no cognisance of the order of his Superior (FAA) and the applicants suffering because of non compliance at the levels of the public information officers. The powers of each officer including powers of supervision over subordinates involved in the chain of decision making, should be identified in the form of a flow chart explaining the rank /grade of the public functionaries, as related to the good governance and involved in the decision making process and the specific stages in the decision making hierarchy. Clauses (2) to (6) of Article 19 , however, provide for the operation of existing laws and empowers the state Government to make any law imposing reasonable restrictions in the interest of sovereignty and integrity of India or public order or morality etc, on the exercise of these rights. The term "Law" or usage having the force of Law. International human rights law Codifies this Millian absolutism. Article 19 of the international covenant on civil and political rights protects freedom of expression regardless of frontiers and in the form of art. The UN Human rights Committee declared that blasphemy laws are incompatible with the covenant, unless they qualify as incitement. The European Court of Human Rights similarly protects expression that"offends shocks or disturbs " , affirming that artistic freedom is " Essential for the democratic society " The Venice Commission called for abolishing all blasphemy laws. RTI ACTIVISTS AND THE VOLUNTEERS FACING PROBLEMS BECAUSE OF DEFUNCT STATUS OF THE (SIC) AND APPROPRIATE GOVERNMENT SILENT ON THE MATTER, FOR ABOUT ONE YEAR OF DURATION
Civil society organisations playing a vital role in implementation of the Right to Information Act, 2005 and the RTS Act adjudication related to the citizens charters mandatory for all Ministries/departments and the public authorities, however there is no awareness among the people, where in the public authorities shall constitute consultative committees consisting of office bearers of key stakeholders, association on rotational basis to have a systematic and regular interaction between the officials of the Public Authorities to advise what information to be used as suo motu. Information and Facilitation centres may be set up in each public authority, where public dealing is involved to educate the citizens about the information/documents and also to provide the printed publications to the citizens. INDIAN ROADS CONGRESS AND PURPOSE OF THE EXPECTED DETERMINATION
The Indian Roads Congress publishes hundreds of standards, guidelines, and specifications relating to road safety and construction. These documents cover a wide range of the technical guidelines and pertinent issues, including route signage for the national highways, vehicles design and dimensions and weights and measures and the design of prestressed concrete road bridges. These standards are widely incorporated into the government practice and model appearing in the subordinate legislation as well as in regulations issued by the bodies like the rural development infrastructure and the National Development Agencies and the Ministry of Road Transport and Highways. RTI IS BECOMING A NEVER ENDING STRUGGLE OF ACCESS TO INFORMATION WHERE SPIO FAILED TO SUPPLY CORRECT AND THE COMPLETE INFORMATION, SPIO HAS NO RIGHT TO DENY THE RECLAIM OF APPLICANT
RTI and the RTS Act adjudication empowered by the Government to Citizens of country becoming a never ending struggle to follow civil procedure code -1908 , where in the Haryana State Information Commission has clarified that no applicant may be denied to repeat his reclaim of access to information under law code manual prefixed by the Constitution of India in this behalf, list by way and virtue of which no applicant would be targeted for never ending struggle to reclaim the procedure laid down , while enquiring into any matter under this section and SIC or CIC have the same powers as are vested in a civil court while trying a suit under the code of Civil procedure, 1908,in respect of the following matters, namely (a) summoning and enforcing the attendance of persons and compel them to give oral or written evidence on oath and to produce the documents or things;(b) requiring the discovery and inspection of documents (c) receiving evidence on affidavit;(d) requisitioning any public record or copies thereof from any court or office; (e) issuing summons for examination of witnesses or documents;and (f) any other matter which may be prescribed. STATE GOVERNMENT AND WORKING OF THE GOVERMENT REGULATED UNDER ARTICLE 166 OF THE CONSTITUTION, RELATED TO REVIEW AND ANALYSING POLICY HAS NO INFORMATION AND (SIC) IS IN DEFUNCT POSITION FOR ABOUT ONE YEAR OF DURATION
Rules under Article 166 of the Constitution describing allocation of business and working of the Government regulated under orders and provision of the Rules where in the Rule 2 of the business of the Government of Himachal pradesh (Allocation) Rules 1971 provides that the entire business of the Government shall be translated in the Departments of Himachal pradesh, specified in the schedule and shall be classified and distributed between those departments as laid down there in. Further Rule 4 of these rules provides that there shall be a Secretary for each department who shall be the official Head of the Department. The Rules of business provides for a permanent Secretariat divided into the Departments, each with the designated set of activities and clearly defined procedure. This Secretariat is primarily meant to provide support to the Council of Ministers in discharging its constitutional obligations and in taking various decisions concerning the welfare of the State and the people. The actual implementation of programmes is done by the field staff of the various departments and these activities and the staff are controlled from the day to day functioning point of view by Directorates, so that the Secretariat departments are left free to concentrate on issues relating to the policies, planning and the overall implementation. The Directorates in addition to expecting programmes also act as agencies to collect and interpret data and provide appropriate information to the Secretariat departments in framing, reviewing and analysing policy matters. MONITORING AND REPORTING OF WORK DONE UNDER THE RTI ACT, 2005 DURING EACH YEAR MUST HAVE AN EFFORT BY THE PUBLIC AUTHORITIES TO ADMINISTER AND IMPLEMENT THE SPIRIT AND INTENTION OF THIS ACT
Every information issued under sub section (4) shall be laid before the State legislature but it is regretted to point the non compliance at the levels of the Vidhan Sabha where no monitoring and reporting made practicable after the end of each year, required to prepare a report on the implementation of the provisional of this Act during that year and forward a copy thereof to the appropriate Government. Further more each Ministry or department shall in relation to the public authority within their jurisdiction, collect and provide such information to the State Information Commission, as is required to prepare the report under this section and comply with the requirements concerning the furnishing of that information and keeping of records for the purpose of this section.If it appears to the SIC that the practice of a public authority in relation to the exercise of its functions under this Act does not conform with the provisions or spirit of this Act, it may give to the authority a recommendation specifying the steps which ought in its opinion to be taken for promoting such conformity. THE SILT CARRIED BY A RIVER IS THE RESULT OF EROSION BY WATER ON THE SOIL IN THE CATCHMENT AREA OF THE RIVER
The silt carried by a river is definitely a result of erosion by water on the soil in the catchment area of the river The proportion of silt to water and the size of the silt particles carried depends upon the nature of the surface soil, its slope and too the rainfall in the catchment area. Silt carrying capacity of the water in the river too depends on its discharge, surface slope, grade of silt and the silt charge. As for as case of the water in the main canal carries silt with a high silt factor which is gradually reduced in branch canals and minors, however in the case of rivers it totally depends upon the natural flow and based on the natural slopes. There are two classes of silts, as such considerable variations are noticed in the silt charge and silt grade which are carried daily by the water and the silt during summer is muddy and it becomes fine and course sand in winter. The silt charge by weight is maximum in rainy season when the parent river is in floods. As for as the silt in the lakes is concerned it is placed by the floods in the beds, depending upon the nature of slopes and sides, affecting the storage capacity, where it is necessary to follow the silt problem, and the exact quantity and grade of silt that a particular channel should carry, and depends upon various factors, is a vexing problem for the engineer . THE HOME MINISTRY UNDER SECTION 21(2) MUST VERIFY SPECIAL INTENSIVE REVISION OF THE ELECTORAL ROLLS
Political parties are raising issues related to SIR with the points for observation that special revision should be done in a manner fixed by the ECI, whereas intensive revision under section 21(2) needs to be done as per the prescribed procedure. It is not understood why the appropriate government taking no cognisance, as required for the appointments of the SCIC, and SIC in Himachal Pradesh where the existing institution of the Commission is in defunct position for about one years of the duration and theCommissuoners shall be appointed by the Governor on the recommendation of a Committee consisting of-- (1) the Chief Minister, who shall be the Chairperson of the Committee;(11) the leader of opposition in the legislative Assembly;and (111) a Cabinet Minister to be nominated by the Chief Minister and where leader of opposition in the legislative Assembly has not been recognised as such, the leader of the single largest group in opposition of the Government in the legislative Assembly shall be deemed to be the leader of the opposition. The SCIC and SIC, shall while enquiring into the matters, have the same powers, as are vested in a civil court while trying a suit under the code of Civil procedure, 1908,in respect of the following matters:-- Summoning and enforcing the attendance of persons and compel them to give oral or written evidence on oath and to produce the documents or things. (b) requiring the discovery and inspection of documents; (c) receiving evidence on affidavit;(d) requisitioning any public record or copies thereof from any court or office;(e) issuing summons for examination of witnesses or documents, and (f) any other matter which may be prescribed. Further more, during the inquiry of any complaint under this Act, examine any record to which this Act applies, which is under the control of the public authority, and no such record may be withheld from it on any grounds. On the other hand the Government of India also responsible for the taking cognisance of the such delays and dereliction of duty and do needful under law code manual prefixed by the Constitution of India in this behalf, so that people may not sufffer more and more due to such pendency in the system for fast justice track. RTI PLAYING AN IMPORTANT ROLE IN THE RURAL DEVELOPMENT, WHERE PROBLEMS RAISED BY THE PEOPLE ARE KEPT PENDING, BECAUSE OF DELAY AND OTHER REASONS, AND THE RTI IS ONLY A REMEDY FOR HIGHLIGHTING THE GENERAL PROBLEMS
It was an occasion today on 5-6-2026 when visited the Kalol in connection with function of father-in -law's Chaturwarsic sharadh along with family and come to know from the relatives and friends that link road from Kalol to Majher under repair has been lying pending from bifurcation to the Gate of the Senior Secondary School Kalol, even the portion further linking the village has been completed but about 120 metres of link road near the school and the Hospital still without any repair for which people are complaining again and again before the public representatives of the area and circle but nothing concrete has been done so for in the matter, while contacted the Junior Engineer and Assistant Engineer HPPWD Kalol in meeting on the captioned subject in sub divisional office, it was told by the office and authority that detailed estimate for the repairs have been submitted to the Divisional office at Jhandutta since 18-4-2026 but issue and matter yet pending for further sanction of the Deputy commissioner Bilaspur Himachal Pradesh and at present there is no Executive Engineer in the Divisional office at Jhandutta, list by way and virtue of which it is becoming difficult to take further sanction , however the matter would be referred shortly to the Deputy Commissioner Bilaspur for allotment of funds amounting to rupees three lakh approximately. Keeping in view it is necessary for the Government to have decision making on the captioned subject matter deliberation required to be furnished for such incomplete works of the area and circle so that people may not feel uncomfortable because of such incomplete repairs of the works under review and wrongly withheld for want of completion of works, where the deposits are sanctioned from the Deputy Commissioner instead of the department of Public Works.
