CIVIL SOCIETY ORGANIZATIONS ARE CHALLENGING THE WORK FIELD CULTURE OF POLITICAL PARTIES AND SHOWING THEIR RESENTMENT AGAINST THE STEPS WHICH OUGHT IN ITS OPINION TO BE TAKEN FOR PROMOTING TRANSPARENCY AND ACCOUNTABILITY, EMPOWERED FOR GOOD GOVERNANCE AND THE CITIZENS CHARTERS ASSURED UNDER (RTS)
It is a matter of fact and concern to be taken into consideration by the all political parties and the leaders of the said main groups working for the leading position of empowerment by way of elections held for the Urban Development department and too for the Panchayati Raj institutions, working for the general public welfare and resulting out on different positions of the work and conduct contrary to the working of the political parties and the leaders of their interim protection, willing to lead for their candidates, however failed to get their work done as per their choice and prediction in the on going elections of the Urban development department and the Panchayati Raj institutions, working for the rural communities and welfare of the people, list by way and virtue of which it is very clear that people are not satisfied with their work and conduct and demanding, vote for the true democracy for the people by the people and to the people, where the Right to Information and the citizens charter too working for the awareness and advancement of the public and are mandatory for each Ministry/department/Authority, created for laying down norms of performance for major function and for monitoring achievements against those standards of the higher level political forums and platforms for the democracy for the people by the people and to the people, where norms have been specified for the discharge of its functions by any statute or the Government orders, particularly linking with them with the decision making process, detailing and describing entitlements for the good governance and accountability, however ignored for the transparency and charter of public accountability and, and criterion and priorities under which a person becomes eligible for the benefits. Keeping in view of technical nature of such vision and programme for the accuracy and correctness various organizations and NGOs as well as RTI activists and volunteers are also taking part in the civil society field of task force for resentment against the political parties and leading groups working for the public opinion and good governance. No doubt these groups are not in position to win over the majority votes however challenging the work done by their candidates, selected for the representation by the political parties and denied by the general public for leading public opinion under provision made for the schedule of elections. SECTION 4 OF THE RIGHT TO INFORMATION ACT, 2005 SETS OUT A PRACTICAL REGIME OF TRANSPARENCY IN THE WORKING OF THE PUBLIC AUTHORITIES, SO THAT THE PUBLIC MAY NOT HAVE TO RESORT SECTION 6.
Section 4 of the Right to Information Act, 2005 sets out a practical regime of transparency in the working of the public authorities by way of disclosure of as much information to the public as possible, suo motu so that the public may not have to resort to Section 6 , It is an important part of the Act, observance of which is essential for its effective implementation. It is obligatory for all the public authorities to publish all relevant facts while formulating important policies and announcing decisions affecting the public, they are also obliged to provide reasons for their administrative or quasi judicial decisions to the affected parties. Section 4, of the Act requires wide dissemination of every information required to be disclosed , suo motu in such form and manner which is accessible to the public. Dissemination may be done through notice boards, news papers, public announcements, media broadcasts, the internet or any other means. PUBLIC PRIVATE PARTNERSHIP (PPP) AND INFORMATION RELATING TO PPP AND THE CITIZENS CHARTER PERFORMANCE AGAINST THE BENCHMARKS, SET IN THE CITIZENS CHARTER
RTI activists and volunteers are taking cognisance of the Citizens charter prepared by the Ministry/department, as part of the result framework document of the department/organisation under PPP and should be proactively disclosed and six monthly report on the performance against the bench marks set in the citizens charter should also be displayed on the website of the public authorities. Further more, if public services are proposed to be provided through a public private partnership (PPP) , all information relating to the PPPs must be disclosed in the public domain by the public authorities entering into the PPP contract/concession agreement. This may include details of the Special purpose vehicle (SPV) if any set up, details project reports, concession agreements, operation and maintenance manuals and other documents generated as part of the Implementation of the PPP project. The documents under the ambit of the exemption from disclosure of information under section 8(1) (d) and 8(1) (j) of the RTI act would not be disclosed suo motu. Further, information about fees, tolls or other kinds of revenue that may be collected under authorisation from the Government, information in respect of outputs and outcomes, process of selection of the private sector party may also be proactively disclosed. All payments made under the PPP project may also be disclosed in a periodic manner along with the purpose of making such payment. It should be the endeavor of all public authorities that all entitlements to citizens and all transactions between the citizens and the Government are gradually made available, as the departments reorganize their systems and processes to enable themselves for electronics service delivery, it is recommended that the requirements of bringing due transparency as provided in the RTI Act is given adequate consideration at the design stage itself. RTI, WORKING AS A TOOL OF DEMOCRACY AND REPORTING THE COMPLIANCE BEFORE APPROPRIATE GOVERNMENT FOR ADMINISTRATIVE REFORMS
It was an occasion today on 28-5-2026 when visit to the local poling station and caste vote for the Panchayati Raj institutions along with family and realised that people are interested to vote their democratic rights for the fundamental predictable governance and institutional consistency, however it has also been observed during the course of this study for the democracy for the people by the people and to the people that voters are also trying their level best to caste their votes on the basis of caste and community, instead of electing their representatives on the basis of report cards of the candidates and their social service for the area and circle, as a result of innumerable changes that society and area has undergone during the past tenure of the service rendered by the letter and spirit through their contribution for the welfare of society and circle list by way and virtue of which it is necessary to promote transparency and accountability in the administration and empowered by the parliamentary democracy of our country to the citizens for improving system generated for public trust and accuracy as well as accountability where our trust becomes a strategic asset fo cooperation and coordination of the individuals honesty, hard work and social work for the society and circle, but it seems that voters are generally depending upon their caste, region and community welfare instead of general communication and handling of the predictable governance and institutional consistency, even the government is responsible for debate and dialogue , which could be protected through Right to Information and citizens charters and making administrative reforms open for the society and circle under law code manual prefixed by the Constitution of India in this behalf, but allowing criticism of this Act for the empowerment is an illegal proceeding of the appropriate Government, even the ruling party and the opposite front taking such debate and corrective measures under law code manual in their discussion and dialogue before the Institutional platform at Vidhan Sabha and the Parliament . The process and procedural compliance definitely working for the good governance and accountability during the held discussion before the FAA and SIC or CIC but there is no understanding and advancement of this

DELAY IN DECISION-MAKING PROCESS AND PROCEDURE, CREATING PROBLEMS TO THE PEOPLE UNDER SUB -SECTION (3) OF SECTION 12 OF RTI ACT, 2005 , WHERE THE (SIC) IS IN DEFUNCT POSITION, FOR ABOUT ONE YEAR.
The question has been raised in the present ongoing circumstances of the incomplete justice by forum for justice and delivery of justice by the High Courts , where it is revealed that the powers of the High Courts under article 226 of the Constitution of India are certainly not at par with those of the Supreme Court of India under Article 142 of the Constitution, however to deliver justice is a wide concept of the judiciary and shall always be complete, thus the High courts may also deliver complete justice thought in a more circumscribed manner than the Supreme Court, whose inherent powers under Article 142 serves as one of the tools for applying the concept of due process of law in rapidly changing social, economic, political and value based system of principle of justice. Friends, Panchayat Elections are very close in the coming days and where it is necessary to follow the vision good governance and accountability prefixed for the welfare of society and circle under Right to Information and the Citizens charters, list by way and virtue of which A citizen has a right to seek such information from a public authority, which is held by public authority or which is held under its control. This right includes inspection of works, documents and records, taking notes, extracts or certified copies of documents or records, taking certified samples of material held by the public authority or held under the control of the public authority. The basic object of the Right to information Act is to empower the citizens, promote transparency and accountability in the working of the Government, contain corruption, and make our democracy work for the people by the people and to the people, in a real sense. Democracy under pressure and too in trouble where India is in a dire need of taking out criminals from the politics because for an efficient governance people with clean image and character are required . For doing this the Legislature, Election Commission, Supreme Court and the Civil society organizations can work in tandem. Where people may take various measures for resolving this issue such as, there should be strong laws against the entry of criminals in politics, fast track courts for criminal cases against the politicians and citizens should be made more aware of their candidates, political parties should also prevent themselves from giving tickets to criminals and state funding of elections can also be initiated to curb the use of money power, model code of conduct can be enforced in a strong manner to stop the use of caste and religion in politics. MINUTES OF ONLINE MEETING HELD UNDER THE BANNER OF NATIONAL CAMPAIGN COMMITTEE ON 24-5-2026 (11.00.am TO 1-15 PM) --DEMOCRACY UNDER PRESSURE.
It was an occasion today on 24-5-2026 when attended online meeting under the banner of National Campaign Committee held on the captioned subject matter deliberation required to be argue democracy under pressure and said event was concerned by Shri Shivanand Diwedi, Shri Praveen Patel and Shri Rahul Singh former SIC Madhya pradesh and resource person from Uttrakhand Shri Virendra Kumar Thakker along with other members and new era entrants . All the guides and senior key members expressed their view points on this occasion and seems to be unsatisfied , in this behalf of the work and conduct taken in hand by the public authorities for retention and maintenance of the RTI documents, provisionally made available to the applicants under section 6(3) of the right to information Act, 2005 and further under procedural compliance through Appeals and Complaints for the timeline action, however it is revealed that general public is not satisfied from the work and conduct of the public authorities and complaining against the public information officers with arguments that the decisions of the Commission are binding and the public authorities should ensure that orders passed by the Commission are implemented, however if any public authority or a public information officer is of the view that an order of the Commission is not in consolance with the provisions of the Act, it may approach the High Court by way of the Writ petition. BCCI TOO RESPONSIBLE TO FOLLOW, PARTICULAR OF PLANS, PROPOSED EXPENDITURE AND REPORTS ON THE DISBURSEMENT MADE TO INDIVIDUALS
It is not understood , how order of the CIC changing the held that BCCI being registered, as a private Association of the individuals cannot be treated as a public authority under the RTI Act, 2005 wherein, the government infrastructure and funding for the development of this play game used for the functioning with in India or abroad, hence it is against the natural justice to deny RTI related informations to the applicants, moreover , in earlier decision making by the CIC during, 2018 , it was held that the BCCI qualified as a public authority, under the RTI act, 2005 and it is necessary to have appointment of the Public information officers, required to establish the compliance frame work under RTI. DEMOCRACY IS WORKING FOR TRIAL AND ULTIMATELY DEPENDING UPON THE JUDICIARY FOR FINAL CONCLUSION, WHERE THERE IS NO TIMELINE FOR DECISION-MAKING AND PEOPLE FACING PROBLEMS
In the system of our democracy in India the election is a temporary phase of empowerment for the period of five years of duration and the system generated for the welfare of people of country virtually maintained by the administration and where it is necessary to transfer the working officials and officers of the departments so that they may not follow monopoly on the captioned subject of work and conduct as well as required efficiency in the administration for which three to five years of duration has been suggested by the DoP&T for policy under law code manual prefixed by the Constitution of India in this behalf, however the ruling parties are taking no cognisance of the such policy matters and deciding at their own, as required for their goodwill. PEOPLE MUST VERIFY REPORT CARD OF THE CANDIDATES INSTEAD OF THEIR PROMISES FOR THE VOTERS
People of area and circle are requested to verify the report card of their candidates appearing before the general public for their vote and support, instead of looking for their future plan and promises made for the public welfare components under schedule for decision making process and provision on the captioned subject matter deliberation required to be finalised under various guidelines and instructions for the design and consideration as well as funds for the allotment. It is observed that the candidates are taking no cognisance of the schedule for proposed works and promising the general public at their own level, even though it is planned under codes for consideration and decided on the basis of equity for the all under law code manual , however there is no investigation and the facts reveal of cases for consideration, required to be referred to the planning department and the design presentation, competent to sanction such proposals on the basis of their schemes for the future summary before the administration taking cognisance of the such demands and programmes, as a result of the changes made there is no vision of the promises made and people themselves will have to get involved, if there has to be a real and strict necessitated necessity of the demand under public utility/service for the usefulness of the people welfare, introduced for the recognised society and circle as well as area and society, as the case may be. The role of the civil society's people in the democracy of our country is more important, where they are also responsible to protect the fundamental rights of the citizen's charter for which the right to information empowered by the parliamentary democracy of our country, but it is regretted to point that very few people are taking cognisance of the said Act and conduct, related to the law code manual prefixed by the Constitution of India, in this behalf, however it is necessary to watch and ward the process created for laying down norms of performance for the major functions and required for monitoring as well as achievements , against those standards of the democracy for the people by the people and to the people. Detailing and describing the processes by which the general public can access and/or receive the goods and services that they are entitled to, from the public authorities/office, too describing the conditions, criteria and the priorities under which a person becomes eligible for the goods and the services and consequently the categories of people who are entitled to receive the goods and the services. Laying down individuals responsibility for providing the goods and services and implementation and responsible for the supervision. The powers of each officer including powers of supervision over subordinates involved in the chain of decision making, should be identified in the form of a flow chart explaining the rank /grade of the public functionaries, as related to the good governance and involved in the decision making process and the specific stages in the decision making hierarchy. On the other hand the political participation refers to the involvement in election related activities, such as attending campaign meetings and rallies, taking part in processions and participation in door to door canvassing, distributing election pamphlets and putting up their posters and sharing the campaign messages of political parties or candidates on platforms, working for their wining schedule for success in their vision power corridor. STATE GOVERNMENT OF HIMACHAL PRADESH, FAILED TO BRING CITIZENS CHARTERS, WHICH ARE MANDATORY, DUE TO DEFUNCT STATUS OF (SIC) FOR THE LAST ABOUT ONE YEAR

RTI AND THE RTS ACT FOR USE OF PUBLIC OPINION BECOMING HELPLESS TO THE PUBLIC OPINION FOR THE LAST ABOUT ONE YEAR, AS SUCH THERE IS NO MONITORING AND REPORTING ON THE CAPTIONED SUBJECT
No doubt the Right to Information Act, 2005 and the RTS helping in finding delay and dereliction of duty at public authority level but the public authorities are taking no cognisance of the accuracy and correctness of the rule and law empowered for the welfare of general public and cases are kept pending without any solid reason of the such excuse, list by way and virtue of which it is becoming difficult to take benefits of the said Act related to access to information and the charter of public accountability and the state governments are taking no cognisance of the monitoring and reporting on captioned subject required for good governance and accountability in this behalf of the demand under public service guarantee, where now a days penal action required for implementation of the Act in positive direction has also been ignored by the respective state Governments and no disciplinary action is taken against the defaulters, even it is necessary for the good governance and accountability but there is no appropriate implementation of the Act. The RTI welfare Association and its task force taking cognisance of the representation of civil societies organisation and active in the field of Right to information, for strengthening compliance under the provision made, based on the report of the task force, doing their duty well within the mechanism for the transparency and accountability however the public authorities are taking no cognisance of the time lines and accuracy and enforcing delay and dereliction of duty without any reason of the access to information under the control of the public authorities , in order to promote transparency and accountability in the working of every public authority, list by way and virtue of which it is necessary to harmonise revelation of information in actual practice likely to conflict with other public interests including efficient operations of the Governments, optimum use of limited fiscal resources and the preservation of confidentiality of sensitive information. Additionally, in the routine work of governance, Government functionaries are required to make decisions in a discretionary manner, but broad -guiding principles are laid down in some rule or the other and it is necessary to update the things other wise no correct vision of the Right to Information may be obtained from the concerned public authority. The general superitendence, direction and management of the affairs of the State Information Commission shall vest in the Chief Information Commissioner, who shall be assisted by the Information Commissioners and may exercise all such powers and do all such Acts and things which may be exercised or done by the Chief Information Commissioner autonomously without being subjected to directions by any other authority under this Act. STATE GOVERNMENT OF HIMACHAL PRADESH TAKING NO COGNISANCE UNDER SUB -SECTION (3) OF SECTION 12 AND THE (SIC) STILL WITHOUT ANY COMMISSIONER, FOR LAST ABOUT ONE YEAR
It is not understood how the present state government working for the welfare of society and circle, under the circumstances when there is no Commissioner and the Chief Information Commissioner since for the last about one year of duration, even though the Information commissioner, after the end of each year, are required to prepare reports on the implementation of the provision of the Act during that year. Each Ministry or department is required, in relation to the public authorities within its jurisdiction, to collect and provide information to the concerned information Commission for preparation of the report. The report of the Commission, inter alia, contains following information in respect of the year to which the report relates:-- (a) the number of requests made to each public authority (b) the number of decisions where applicants were not entitled to access to the documents pursuant to the requests, the provisions of the Act under which these decisions were made and the number of times such provisions were invoked. (c) particulars of any disciplinary action taken against any officer in respect of the administration of the Act (d) the amount of charges collected by each public authority under the Act, and (e) any facts which indicate an effort by the public authorities to administer and implement the spirit and intention of the Act. No doubt the RTI is working for the welfare of society and community as well as individual for access to information actively taking cognisance of the future problems of the area and circle and asking for the improvement of such realisation under provision made by the Government however it is not a duty of the RTI activist and volunteer to follow lawsuit and they are not parties with a direct stake in the dispute observed by the identity in the work and conduct of the documentary proof taken from the public authority in this behalf of the demand under public service and verified under the provision of settlement for good governance and accountability where the department of administrative reforms and the entire government held responsible for such consequences of disparity made and enforced with any area or circle as well as an individual concerned, for which it is necessary to have representation before the appropriate Government responsible for doing needful under the provision made and in generally it is felt that such complaints are decided by the public authorities, however it is necessary to explain the purposes made for the information disseminated widely and in such form and manner which is easily accessible to the public, fiduciary related for disclosure with all relevant facts formulating important policies for the decision making of representation for the effective implementation of the schemes and programmes, but the people does not follow their proposed plan, as required under the provision of development and accountability for each area and circle or an individual, as the case may be, and consider it their disparity against the given schedule for service and utility. Friends, It is a matter of fact and concern to be notice by the every citizen of country facing various problems in the system of democracy for the people by the people and to the people that RTI has been empowered to the citizens of country under law code manual prefixed by the Constitution of India in this behalf, but at the same time it is necessary to follow procedural compliance and processing of the access to information and follow powers and duties of its officers and employees and the procedure followed in the decision making process including channels of the supervision and accountability and the norms set by it for the discharge of its functions. The rules, regulations, instructions manuals and records, held by it or under its control or used by its employees for discharging its functions and a statement of the categories of documents that are held by it or under its control. The particulars of arrangements that exists for consultation with, or representation by the members of the public in relation to the formulation of its policy or implementation thereof. A statement of the boards, councils, committees and other bodies, consisting of two or more persons constituted as its part or for the purpose of its advice, and as to whether meetings of those boards, councils and committees and other bodies are open to the public, or the minutes of such meetings are accessible for the public. The particulars of the facilities available to citizens for obtaining information, including the working hours of a library or reading room, if maintained for the public use and such other information as may be prescribed and there after update these publications, every year and public all relevant facts while formulating important policies or announcing the decisions which affect the public and also to provide reasons for its administrative reforms or quasi judicial decision to affected persons. Political parties are required to maintain report card of the aspirants for the election to Urban development and the Rural development of Panchayati raj department, now a days trying for the selection through their senior leaders of the party forum for selection. Keeping in view the social service required for these highlights of the election, there is no opportunity for the winners except to work for the society and area of their post, as such they must follow the existing problems of the public and the people are given opportunity to discuss their problems with the implementation institutions and understand their problems where functionaries compliance with all requirements could not be ignored by the representatives of their area and circle related to the post for service under law code manual prefixed by the efficiency and efficacy shown in discharge of duties and exercising of powers as per the general activities and analysis of facts processed for the welfare of general public, and grievances for the redressal for which experience and access to information also matters under such conditions of the demand for control of any official machinery, but it is regretted to point that very few people are taking cognisance of the Right to information Act, 2005 and the charter of public accountability and the people facing problems because of the delay and dereliction of duty where the representatives are also denied by the administration to have action under the provision made for display, even at the panchayat levels where it is required to be updated after quarter and half years duration of the work, done and the progress made at the site of work and people are themselves responsible to monitor their problems and follow higher office and authorities in such cases of the law of limitations. SHOULD THE JURISDICTION OF PUBLIC INTEREST LITIGATION (PIL) BE RECONSIDERED?
Public interest litigation (PIL) emerged as a transformative judicial innovation aimed at widening access to justice for the poor people and the marginalised .
