PEOPLE FACING PROBLEMS IN ACCESS TO INFORMATION UNDER SUB -SECTION (3) OF SECTION 12 OF RIGHT TO INFORMATION ACT, 2005 AND THE SIC IN DEFUNCT POSITION AND STATUS OF DESIGNATED OFFICERS

It has been noticed by the DoP&T memo number 1/34/2013-IR dated 29th June, 2015 that recommendations made by fiduciary disclosure of the service matters, the information relating to recruitment, promotion and transfers should be brought into public domain promptly, in order to reduce the number of RTI applications and minimize the burden of the servicing RTI applications, where in the public authorities with high public dealings should put in place an effective system to redress the grievances of affected persons. Despite assurance made under the provision of MGNREGS and Act taking cognisance of the demand for livelihood the state governments are denying the work for the people, even though it has been converted into the VB--RAM-G scheme by Government of India but there is no assurance of the mandays committed for this security of the service for employment and issued under the Act, list by way and virtue of which people are facing problems due to denial of their committed schedule for the employment guarantee under law code manual prefixed by the Constitution of India in this behalf. Right to information is a practical regime for citizens of the country to secure access to information under the control of public authorities, so there is no question of delay and denial in working of every public authority but it is regretted to point out the non compliance and knowingly misconstrued supply of information to citizens who desire to have it, list by way and virtue of which people are compelled to approach FAA and SIC or CIC as the case may be, even though and more over, information and data should be presented in open data formats whereby it can be pulled different Application Protocol interfaces to be used in different fashions more appropriate to specific contexts and needs. PLASTIC WASTE DISPOSAL A MATTER OF SIGNIFICANT PUBLIC IMPORTANCE:CENTRAL INFORMATION COMMISSION

The Central Information Commission (CIC) has said matters concerning the implementation of guidelines for the disposal of thermoset plastic waste of significant public importance, as it has serious environmental implications. In an order, Information Commissioner PR Ramesh reprimanded the Central Pollution Control Board (CPCB) for repeated failures to provide details under the Right to Information Act on action taken regarding the enforcement of guidelines for disposal of thermoset plastic waste, including fibre reinforced plastic. As the thermoset plastic cannot be remelted or reshaped once set, and their disposal is considered highly difficult. The issues raised by the appellant are of significant public importance, and appropriate action is required to ensure effective and transparent implementation of the guidelines issued by the CPCB, the CIC observed. The CIC further noted that despite clear directions from the First Appellant Authority (FAA) the CPCB failed to furnish point wise replies to multiple RTI applications and did not allow inspection of records in several cases. Admonishing the conduct of the than Central Public Information Officer (CPIO) , the Commission said, it amounted to a gross violation of the provisions of the RTI Act, Adding further that such conduct reflected a casual behavior of officers towards the RTI Applications. MISSING RECORDS NO BASIS TO DENY (RTI) INFORMATION

The information can not be denied under the right to information Act, 2005 on the ground that records are missing. The Punjab state information commission has taken a serious view of such a plea by the Punjab state Warehousing Corporation, the Commission has directed its managing director to look into the matter and ensure that appropriate action is taken regarding the missing records. The commission observed that the department did not provide the requested information on the ground that the records could not be traced. It further noted that the respondent can not evade its responsibility to provide information merely by stating that the records can not be located. The commission said, efforts must be made to trace the records and supply the information sought by the applicant. The commission also observed that the department did not implement section 4 of the RTI Act, 2005 which mandates that every public authority must maintain its records duly catalogued and indexed in a manner that facilitates access to information under the Act. It further noted that records that are appropriate for computerisation should be computerised within a reasonable time, subject to the availability of resources and also connected through the net work across the country on different systems. Emphasisting this provision, the commission said failure to maintain proper records can not be used as a ground to deny information under the RTI, Act, 2005 . In view of these observations the commission directed that a copy of the order be sent to the MD of the Punjab State Warehousing Corporation to examine the issue, ensure necessary action regarding the missing records, and submit a compliance report before the next hearing. DECISION-MAKING CHAIN SHOULD BE IDENTIFIED EXPLAINING THE RANK /GRADE OF THE PUBLIC FUNCTIONARIES INVOLVED IN THE DECISION-MAKING PROCESS AND THE SPECIFIC STAGES IN THE DECISION-MAKING HIERARCHY, UNDER RTI ACT, 2005

In the routine work of governance, Government functionaries are required to make decisions in a discretionary manner but broad guiding principles are laid down in some rule or the other. For example the General Financial Rules lay down procedures for a variety of operations relating to Government finances. How sanction must be accorded for the incurring expenditure, how losses to Government must be reported; how responsibility for losses may be fixed on any Government servant;how budgets, demand for grants are prepared and submitted;how public Works must be sanctioned and executed;how commodities and services may be procured by a public authority; are all explained in the manuals, which are required to updated time to time. The challenge is to present a simplified version of the decision-making procedure that is of interest to a common citizen. As such all government officers have to follow laid down office procedure manual or the other rules which gives details of how representations, petitions and applications from citizens must be dealt with. Templates, formats, and the basic steps of decision making are briefly explained in the manuals of related codes for consideration and these descriptions constitute the elements of decision making process in general. In view of the above explanation, the guidelines for detailing the decision making process, every public authority should specifically identify the major outputs/tangible results/services/goods as applicable, that it is responsible for providing to the public or to who soever is the client of the public authority. (5) Information that is proactively disclosed must be properly categorized and orgsnised in such a manner that it facilitates easy retrieval. The state Government of Himachal Pradesh department of Administrative Reforms vide letter number ADR-A0003/4/2023-Administrative reforms dated 12-3-2026 has declared that, State Vigilance &Anti Corruption Bureau has been excluded for information disclosure under the Right to Information Act, 2005 , where in the fiduciary exemptions from disclosure are described with clarification stated under Sub section (1) of Section 8 and Section 9 of the Act enumerate the types of information which is exempt from disclosure. Sub section (2) of the Section 8 , however, provides that information exempted under sub -section (1) or exempted under the official secrets Act, 1923 can be disclosed if public interest in disclosure overweighs the harm to the protected interests. (2) The information which, in normal course, is exempt from disclosure under sub section (1) of section (8) of the Act, would cease to be exempted , if 20 years have lapsed after occurrence of the incident to which the information relates. However, the following types of information would continue to be exempt and there would be no obligation, even after lapse of 20 years, to give any citizen--- (a) Information disclosure of which would prejudicially affect the sovereignty and integrity of India, the security strategic, scientific or economic interest of the State, relation with foreign state or lead to incitement of an offence; (b) Information, the disclosure of which would cause a breach of privilege of parliament or state Legislature; or (c) Cabinet papers including records of deliberations of the council of Ministers, Secretaries and other officers subject to the conditions given in proviso to clause (I) of sub section (1) of section 8 of the Act. Energy producers in Qatar and Kuwait earlier made similar declarations which are a warning that events beyond their control may lead them to miss export targets. EFFECTIVE SYSTEM TO REDRESS THE GRIEVANCES OF AFFECTED PERSONS/APPLICANTS SHOULD BE ADOPTED BY THE OFFICERS OF THE (SIC) UNDER DEFUNCT SITUATION OF THEIR INSTITUTION, INSTEAD OF INCREASE IN THE PENDENCY/COMPLAINTS

Right to Information Act, 2005 , being the fundamental right under law code manual presently depending upon the Artificial intelligence, where number of groups and societies are working for the promotion of this act and advice for the practical regime under the control of public authorities, in order to promote the transparency and accountability in the working of every public authority however the applicants and volunteers are taught by way of guides and the awareness generation, ethical guidelines and the safety protocols to ensure responsible interaction with the artificial intelligence governed by way of detailed guidelines on implementation of suo motu disclosure under section 4 of the RTI Act, 2005 issued vide Department's OM No 1/6/2011 -IR, dated 15-4-2013 . Subsequently, a committee of the experts consisting of Shri A. N Tiwari, Chief Information Commissioner (Retired) and Dr MM Ansari, Information Commissioner (Retired) (of the central information commission) was constituted to recommend. Inter alia,measures to further strengthen implementation of section 4 of the RTI Act, 2005 The committee has, inter alia, made the following recommendations which have been duly accepted by the competent authority:-- (1) All the details of the public authority may be uploaded on its web site. Access to information should be made user-friendly for which appropriate information technology infrastructure should be suitably designed, developed and operationslised (2) All the training modules for professional upgradation of employees should incorporate matter relating to the virtues of transparency and open Government and RTI law. (3) In order to minimize the burden of serving RTI applications, the public authorities with high public dealings should put in place an effective system to redress the grievances of affected persons. At the sub -organisational levels, there should be co-operation and co-ordination between the Central public information officers and the officers responsible for addressing public grievances (4) In order to reduce the number of RTI applications relating to service matters, the information relating to recruitment, promotion and transfers should be brought into public domain promptly. (5) The retention and maintenance of specific documents for specified duration should be clearly spelt by each public authority in respect of its documents. INDIA JOINS MISSION TO CURB SOCIAL MEDIA MENACE, KARNATAKA AND HIMACHAL ANNOUNCES BAN FOR KIDS UNDER 16 AND TAMIL NADU BANS POLITICAL AND RELIGIOUS EVENTS IN PRIVATE SCHOOLS

With the objective of preventing adverse effects of increasing mobile usage on children, usage of social media will be banned for children under the age of 16,as per the State Government of Himachal pradesh and the Karnatka where as the central government's economic survey tabled in parliament in January this year said aged based access to online platforms should be considered while also cutting down online teaching to avoid digital addiction. In 2025 , Australia became the first country to ban social media for the children under 16.The Tamil Nadu government has formally prohibited private schools from hosting political, ideological or communal activities on their premises, citing the need to maintain school capsus as neutral academic zones. The School Education department, through a government order issued on March 2,has notified significant amendments to the Tamil Nadu private schools (Regulation) Rules The move aims to ensure that educational infrastructure is urilised primarily and exclusively for students welfare and academic instruction. According to the amended rules, no school premises including buildings, play grounds or halls -- shall be used for any programme, meeting, campaigns, or instruction by external persons or organizations that are political, ideological, communal, or divisive. Crucially, the ban applies both during and outside school hours, effectively barring such events on weekends, public holidays, and during winter or summer vacations. Further the Tamil Nadu government clarified that non -sectarian and non -political events, such as blood donation camps, social service programmes, and the cultural functions, may still be permitted. An online RTI welfare event was convened today on 6-03-2026 under the banner of HPCD 3552 from 3-30 pm to 4-30 pm which was attended in connection with the Dharna pradarshan by Chamba zone of members in the premises of the Deputy Commissioner Chamba. Language, arts and culture of state is under the administrative control of department of (Language, Arts and Culture) and where in addition to Secretary of the department the Director language arts and culture is tasked with the managing departmental activities, including the promotion of local languages arts and museums. The policy and programmes and their implementation working for the welfare of public in the federal structure of democracy has no clear vision and decision-making and the entire policies and programmes are having both ways directives by the Government of India and the state Governments, where in issues like old pension scheme and the Revenue deficit grant are lagging behind for correct safeguard and compromise institutional guardrails, required for the credibility. Keeping in view the above situation and position of our democracy by the people to the people and for the people, we are living in the society of union of states and a federal structure of the good governance and charter of public accountability and the states are primarily organised as linguistic states with different mother tongues where the 1961 census reported 1652 mother tongues, and the 1971 census had a list of 108 languages plus another classification called others, where as the 2011 census had listed 1369 mother tongues and 121 languages ,however no one ever asked in the Parliament why 283 mother tongues disappeared during the half century between 1961 and 2011 . The census required to be carried out in 2021 is now on the horizon, and it will be completed in 2027 . The questions to be asked do not include any on OBCs and DNTs. With regard to language-related questions there is a strange rider attached: If a language community does not have more than 10000 speakers, its name will not be published in the census reports. This has no scientific basis. No linguist has ever argued or even remotely suggested that for a language to be a language it must have minimum number of speakers. Besides the distinction between mother tongue and language that the census uses defies logic. It is unfortunate that in the past these criteria were applied while processing the language-related data in the census. India has an age-old tradition of language diversity, and no government should fear the magnitude of such diversity. Added to the census practice in the past the current government has initiated another absurd project in relation to the language diversity. Indian economy is going to be sensitive because of the many reasons like increase in the price rise and policy reforms related to the domestic consumption, where long term growth found necessary by the market for compounding quality business and becoming necessary to depend upon the Agriculture and the forest produce involved in the wealth creation estimated restructuring for the required potential returns, when better placed on the field by the natural certainty, but it is also essential to make it fruitful for the earnings through a system of the good governance and accountability, otherwise it may result in creating major reversal by way of debt for the balanced exposure too related to the global economy and multi asset strategies incorporating gold and other hedges, so the economy of our country also depending upon the oil prices and the wealth is built via persistence not by the prediction. FIDUCIARY EXEMPTIONS CAN'T SHIELD ROUTINE ADMINISTRATIVE DECISIONS, AS PER THE DECISION GIVEN BY PUNJAB CHIEF INFORMATION COMMISSIONER

As per decision issued by the Punjab State Information Commission, it is ruled that fiduciary exemptions under the RTI Act cannot be casually invoked to block routine administrative information. In a ruling reinforcing transparency in public appointments the Punjab state information commissioner observer that fiduciary exemptions under the Right to information Act cannot be casually invoked to shield routine administrative decision making from the scrutiny. The commission further reiterated that fiduciary exemptions are not to be misapplied to shield routine administrative actions from public scrutiny. It also referred to the judgement of the Delhi High Court, where in it is observed that an employee of a public authority is entitled to know all details concerning himself, including reasons for denial of promotion, unless specifically exempt under section 8(1) (e) or (j) . The High Court clarified that fiduciary exemptions are meant to protect information from disclosure to third parties, not from the concerned employees himself. Keeping in view the above decision of the Punjab State information commission and the referred judgement issued by the Delhi High Court no information related to the employees should be denied but it is regretted to point out that the FAA and the public Information officer of the department of public Works Himachal pradesh failed to issue point wise information asked by the department of Administrative reforms on 4-10-2023 and required to be replied under the provision made by section 19(6) of the Right to Information Act, 2005 for which directions of the FAA ignored by the public information officer concerned and FAA himself taking no cognisance of the point wise reply of point number 1,3,4 and 5 where as reply of point number 2 has been given by the Secretary of the department of public Works is proof and evidence but it is regretted for the appointments of SCIC and SIC in the state Government of Himachal pradesh and people are facing problems because of such fiduciary exemptions, where administrative decisions are kept pending by the public information officers and the FAA and section 19(6) denied for the implementation, even though and more over respective Principal Secretary public Works department taking cognisance of the section 19(6) of the Right to Information Act, 2005 and making necessary intervention in the interest of justice to common man demanding free and fair justice from the system of governance, working for the transparency and accountability in  this behalf of the charter of public accountability and administrative reforms:-- Er Fateh Chand Guleria, Director RTI, Welfare Association registered number HPCD, 3552 , Bilaspur Himachal pradesh phone number, 9459334377

RTI ACTIVISTS AND VOLUNTEERS MAY SUBMIT THEIR MONTHLY STATEMENT OF PENDENCY OF CASES BEFORE THE DEPARTMENT OF (AR) AND HEADS OF THE DEPARTMENT MAY BE HELD RESPONSIBLE FOR NECESSARY INTERVENTION, BY THE ADMINISTRATIVE AUTHORITY, KEEPING IN VIEW THE DEFUNCT POSITION OF SCIC

Department of the Administrative reforms is responsible to compile and prepare, each department, pending receipts related to monthly statement with the approval of the Administrative Secretary a monthly statement of the cases pending finalization over three months, required to be submitted to the Chief Minister through the Chief Secretary . It has to be ensured that all cases pending finalization over three months with reasons for remaining pending are included in the said statement. Further more in the case of Directorates and Collectorates, the said statement have the approval of the Head of the Departments or the Deputy Commissioners and the statement should be sent to the Administrative Department with a copy to the Administrative Reforms Section of the Personnel Department on the prescribed format " Monthly statement of cases pending finalization for over three months as on------ Name of the Department---- Name of the section--- Where in it is necessary to explain the level at which held since when and reasons for the delay. Keeping in view the format described above for the said statement of the finalization of cases pending over three months, it is necessary for the RTI activists and volunteers to take their pending cases with the procedure laid above and follow their action under final disposal till the department of the administrative reforms taking cognisance of the pendency and reasons for the said delay, considered as pending failing which it is difficult to obtain the final action and decision required to be circulated/communicated by the administrative Department with a copy to the Administrative reforms section of the Personnel Department.
