STATE GOVERNMENT OF HIMACHAL PRADESH FEELING POWER-STAGNATION AND FAILED TO APPOINT, VACANT POSTS OF THE SCIC AND SIC EVEN ORDER FOR COMPLIANCE BY THE HONOURABLE SUPREME COURT OF INDIA

State Government of Himachal pradesh under power -stagnation and taking no cognisance of the orders of the Honourable Supreme Court of India, issued for decision making under law code manuals prefixed by the Constitution of India, in this behalf since required compliance under sub section (3) of section 12 of the  Right to information Act, 2005 where it is necessary to issue appointment of the SCIC and SIC to remove defunct status and position of the office for hearings

While enquiring into the matters under this section given the same powers, as are vested in a civil court while trying a suit under the code of civil procedure, 1908,in respect of the following matters, namely:-- (1) Summoning and enforcing the attendance of persons and compel them to give oral or written evidence on oath and to produce the documents or the things, so related to review for such conclusions (2) requiring the discovery and inspection of the documents (3) receiving evidence on affidavit (4) requisitioning any public record or copies thereof from any court or office. (5) Issuing summons for examinations of witnesses or documents and (6) any other matter which may be deemed necessary and prescribed for the inquire into the matter, it may initiate an inquiry in respect thereof to any complaint under this Act, examine any record to which this Act applies, which is under the control of the public authorities, and no such record may be withheld from it on any grounds. Keeping in view the above empowerment and the public authorities are taking no cognisance related to their duty and responsibility under section 19(6) and people facing problems because of the delay and dereliction of duty prefixed in this behalf of the conclusion for decision making under quasi judicial function where it is necessary for the FAA to issue a speaking order giving justification for the decision arrived at, however it is regretted to point the non compliance of sub section (3) of section 12 by appropriate Government and issue and matter of appointments of the SCIC and SIC still pending after the retirements of the former officers of the Commission for hearings and decision making under RTI and the RTS act adjudication thereof:-- Er Fateh chand Guleria, Director RTI welfare Association registered number HPCD, 3552 , Bilaspur Himachal pradesh phone number, 9459334377
