CREATION OF A CENTRAL POINT FOR RECEIVING APPLICATIONS AND DESIGNATION OF THE APPELLATE AUTHORITIES, WITH IN THE ORGANIZATION

Sub -section (8) of Section 7 of the RTI Act provides that where a request for information is rejected, the public information officer shall, inter alia, communicate to the person making the request the particulars of the Appellant Authority. Thus, the Applicant is informed about the particulars of the Appellate Authority when a request for information is rejected. There may be cases where the public information officer does not reject the Application, but the Applicant does not receive a decision within the time as specified in the Act or he is aggrieved by the decision of the public information officer. In such cases the applicant may like to exercise his right to Appeal. But in absence of the particulars of the Appellate Authority, the Applicant may face difficulty in making an Appeal. It has therefore been decided that all the public authorities shall dedignate the First Appellate Authorities and publish their particulars along with the particulars of the PIOs. It is therefore requested that all public authorities with more than one public Information officer should create a central point within the organization where all the RTI applications and the Appeals addressed to be First Appellate Authority may be received. An officer should be made responsible to ensure that all the RTI applications or Appeals received at the central point are sent to the concerned public Information officers/ Appellate authorities on the same day . It is particularly mentioned here that an Application under RTI Act, 2005 submitted on 17-5-2022 has been returned back to this Applicant by the department of HP Finance Government of HP Shimla with the comments that it doesn't pertain to his section and the required RTI has yet no communication by the Pay Revision (PIO) department of HP Finance, even clear vision of the FAA also issued under Appeal number2/2024 dated 17-12-2024 and the information still awaited for fiduciary related decision making at the levels of public Works Department, which is undue lingering and torments under the conditions where no SCIC and SIC designated in the State Information Commission, since long, even pay commission report issued on 3-1-2022 for necessary decision and conclusion of the point wise reply of Appellant Application before the department of HP Finance memo (17-5-2022) is proof and evidence on the record of the FAA too responsible under section 19(6) of the RTI act 2005 to either order his PIO for necessary information or he (FAA) himself may supply information to the Applicant under such conditions of the defunct SIC, sitting idle:-- Er Fateh Chand Guleria, Director RTI welfare Association registered number HPCD, 3552 , Bilaspur Himachal Pradesh phone number 9459334377
