HEARING BEFORE THE SECRETARY, PUBLIC WORKS DEPARTMENT, AGAINST INCOMPLETE, INCORRECT AND THE MISLEADING INFORMATIONS, WHERE THE SIC IS IN DEFUNCT POSITION AND STATUS AND HOD TAKING NO COGNISANCE OF THE PENDING COMPLAINTS REFERRED BY THE SECRETARY PUBLIC WORKS:--ER FATEH CHAND GULERIA

It was an occasion today on 30-10-2026 when attended hearing before the FAA cum Additional Secretary, public Works Department HP Secretariat Shimla in connection with non compliance and incomplete information and the misleading informations by the department of public Works for which complaints have been already referred by the FAA cum Additional Secretary Public works department to the Engineer in Chief HPPWD Shimla for taking cognisance of the wrong assessment and adverse affects against functional post protecting due benefits of seniority under Article 23 of the Constitution of India for which option and preference of employees considered at the level of individuals, but there is no follow up action for revision of Assured Career Progression Scheme and  penalties enforced have also been denied for the such action against the will of the employees , however department taking no cognisance and decision on the wrong assessment and adverse affects, forcibly denying FR-22 introduced by the department of Finance vide number Fin (PR) -B(7) - 51/98 dated 16-8-2000 and addition made by the post -specific ACPS vide letter of modification issued vide number PBW -AB (13) -37/95 dated 21-5-2004 more over there is no reason to ignore law code manual prefixed by Article 23 of the Constitution of India in this behalf for which the HOD are held responsible by the Government for doing correction as per the orders of the Honourable High Court of HP issued vide number CWP(T) 15857/2008 dated 25-5-2011 but no action has been taken by the Engineer in Chief HPPWD Shimla in the positive measures of decision -making and wrong assessment of ACPS forcibly continued at this stage of the due benefits, even pay commission report also issued on 3-1-2022 for final review and revision of the cases but there is no fact finding report for correction and decision making under law code manual prefixed by the department of Finance and the personnel, in this behalf and in the contrary functional post compulsory retired, even denied by the Department of Finance
