AAP TURNING DOWN THE MOVE OF OPPOSITE FRONT IN THE CAPACITY BUILDING OF THIRD PARTY MAY AFFECT ADVERSE AGAINST THIS FORCE FOR UNITY, AS RULING PARTIES ARE FACING VOTERS UNITEDLY
Opposition parties are also working for the welfare of people of country, where all are responsible to remain United in the emergency schedule of their demand under public utility and services required for the democratic reforms organisation , where AAP is also working on the captioned subject of polarisation of votes against the ruling parties too united with in the terms of their schedule for ruling over the general public facing problems because of the wrong doings and ill fated decisions at their own and by way of ignorance of law code manual where all are responsible to follow democracy in the present circumstances of the space for each other in the democracy maintained by the all in the capacity of individual and vision democracy where all are responsible for the good governance and accountability under law code manual prefixed by the Constitution of India in this behalf. The AAP move against the opposite front where ruling party also existing in the shape and size of United front for power gains, definitely working against the norms of an existing parliamentary force maintained by the opposition parties and not by the Congress alone will be treated against the federal structure of our present democracy existing in the country with polarisation of two fronts for the political parties and if any political party is working against this performance of the unity move that would be treated a third party in the system of our democracy where there is no place for such protest as the AAP has no strength to work as an third front in the democracy of country. All opposition parties must do needful under the provision of polarisation of votes at two ends, so that ruling party may feel their unity and strength of struggle in the protest for United move of the democracy, working for the welfare of people of country and taking cognisance of the decision making at the end of their thinking for the opposition unity instead of the ruling party of states for which all are responsible for maintaining the parliamentary strength and protest against the ruling party unitedly instead of breaking the strength of this move, where the ruling party is also United for the power gains at third time in the country:-- Er Fateh chand Guleria, RTI welfare Association registered number HPCD, 3552 , Bilaspur Himachal Pradesh phone number 9459334377
THIRD PARTY MAY PREFER APPEAL UNDER SECTION 19 AGAINST THE DECISION OF SUB -SECTION (3) , SO THIRD PARTY HAVE OPPORTUNITY TO MAKE REPRESENTATION UNDER SUB-SECTION (2) .
THIRD PARTY INFORMATION:-- (1) Where a central public information officer or the State public information officer, as the case may be, intends to disclose any information or record, or part thereof on a request made under this Act, which relates to or has been supplied by a third party and has been treated as confidential by that third party, the Cetral public information officer or state public information officer, as the case may be, shall, with in five days from the receipt of the request, give a written notice to such third party of the request and of the fact that the Central public information officer or the State public information officer, as the case may be, intends to disclose the information or record, or part thereof, and invite the third party to make a submission in writing or orally, regarding whether the information should be disclosed, and such submission of the third party shall be kept in view while taking a decision about disclosure of information:Provided that except in the case of trade or commercial secrets protected by law, disclosure may be allowed if the public interest in disclosure outweighs in importance any possible harm or injury to the interests of such third party. (2) Where a notice is served by the Central public information officer or the State public information officer , as the case may be, under sub -section(1) to a third party in respect of any information or record or part thereof, the third party shall, with in ten days from the date of receipt of such notice, be given the opportunity to make representation against the proposed disclosure. (3) Notwithstanding any thing contained in section 7 , the Central public information officer or the State public information officer, as the case may be,shall with in forty days after receipt of the request under section 6 , if the third party has been given the opportunity to make representation under sub-section (2) , make a decision as to whether or not to disclose the information or record or part thereof and give in writhing the notice of his decision to the third party. (4) A notice given under sub section (3) shall include a statement that the third party to whom the notice is given is entitled to prefer an Appeal under section 19 against the decision. WOMAN CAN USE RTI FOR INFORMATION ON HUSBAND'S GROSS INCOME
A wife is entitled to know about her husband's gross income and can seek information about the same through the RTI, the CIC has ruled .Such informations can not be considered as pertaining to a third party informations or beyond the definition of disclosable information under the RTI act publications, the Commission clarified while rejecting the denial of information to a wife seeking data about her husband's gross and taxable income besides directing the income tax department to provide her with the same with in fifteen days of the order . Where as the petitioner had filed an RTI application with the department seeking a copy of her husband's I-T return , following which an officer of the department issued a notice to the husband, apprising him about the data sought by his wife as it belongs to a third party. The husband refused to share the information terming it as Personal, following which the I-T Officer stated that the information could not be provided citing section 8(1)(j) of the RTI act. The petitioner counsel said that the FAA also upheld the decision of the I-T Officer and rejected her first Appeal.
DISCLOSURE OF THE THIRD PARTY INFORMATION
THIRD PARTY INFORMATION:--Where the PIO intends to disclose any information,or record on a request under this Act, which relates to the third party and has been treated as confidential by that third party, the PIO shall with in five days from the receipt of the request , give a written notice to such third party of the request and of the fact that PIO intends to disclose the information and invite the third party to make a submission in writing or orally, regarding whether the information should be disclosed, and such submission of the third party shall be kept in view while taking a decision about disclosure of information, provided that except in the case of trade or commercial secrets protected by law, disclosure may be allowed if the public interest in disclosure outweights in Importance may possible harm or injury to the interests of such third party .(2) Where a notice is served by the PIO under sub section (1) to a third party in respect of any information the third party shall with in ten days from the date of receipt of such notice, be given the opportunity to make representation against the proposed disclosure.(3) The PIO shall with in forty days after receipt of the request under section 6 , if the third party has been given an opportunity to make representation under sub section (2) make a decision as to whether or not to disclose the information and give in writing the notice of his decision to the third party.(4) A notice given under sub section (3) shall include a statement that the third party to whom the notice is given is entitled to prefer an appeal under section 19 against the decision .
