DEPARTMENT OF HPPWD TAKING NO COGNISANCE OF COMPILATION FURNISHED FOR REVIEW AND REVISION OF FORMER CASES OF DYNAMIC (ACPS) AND THE PIO FAILED TO FOLLOW ORDER OF FAA SINCE 10-2-2024 IS PROOF

As for as the First Appeal is concerned, If an applicant is not supplied information within the prescribed time of thirty days or 48 hours, as the case may be, or is not satisfied with the information furnished to him, he may prefer an appeal to the first appellate authority who is an officer senior in rank to the public information officer. Such an appeal should be filed within a period of thirty days from the date on which the limit of 30 days of supply of information is expired or from the date on which the information or decision of the public information officer is received. The appellate authority of the public authority shall dispose of the appeal within a period of 30 days or in exceptional cases within 45 days of the receipt of the appeal. Deciding appeals under the RTI act is a quasi judical function. It is therefore necessary that the appellate authority should see to it that justice is not only done, but it should also appear to have been done. In order to do so, the passed by the appellate authority should be a speaking order giving justification for the decision arrived at, but it is regretted to point out that the FAA cum Superintending Engineer tenth circle HPPWD Bilaspur has taken no decision on the complaints of the appellant against his public information officer where the public information officer failed to supply free of cost information to appellant so decided in order number 12/2023dated 30-1-2024 where in it is clearly concluded by the FAA cum Superintending engineer tenth circle HPPWD Bilaspur as under :-- " In view of above and from the records produced, it is clear that what ever information on point number 1,3,4&5 was not provided to applicant. The public information officer cum Engineer officer tenth circle HPPWD Bilaspur is directed to supply the reply in respect of point number, 1,3&4&5 to the appellate free of cost on or before 10-2-2024 .
