THE HOME MINISTRY UNDER SECTION 21(2) MUST VERIFY SPECIAL INTENSIVE REVISION OF THE ELECTORAL ROLLS
Political parties are raising issues related to SIR with the points for observation that special revision should be done in a manner fixed by the ECI, whereas intensive revision under section 21(2) needs to be done as per the prescribed procedure. The crucial point is whether the ECI can determine what documents are required to prove citizenship. This is a function to be performed by the Home Ministry as it administers the law on citizenship. The ECI's role is to verify citizens related documents, where in the ECI announced the list of documents and asked the voters to produce them. As such the ECI has simply usurping the role of the Union Home Ministry. The Union Home Ministry has not been made responsible under code for consideration in this behalf is also a serious view , required to prove the citizenship . The ultimate duty is related to the inclusion or exclusion from the electoral rolls , while leaving the larger question of citizenship to the competent authority, namely the ministry of the Home affairs . It seems that the Ministry of Home Affairs will have to decide the cases accordingly in the entire exercise under the provision made, required for the large -scale influx of people, deviating from the scheme of law,, resulting in the deletion of millions of voters from the electoral rolls without providing them any effective redress, list by way and virtue of which it is necessary to analyse the entire exercise (SIR) as under wrong provision of law, however the determining the documents to prove citizenship is a function to be performed by the Home Ministry:-- Er Fateh chand Guleria, Director RTI welfare Association registered number HPCD, 3552 , Bilaspur Himachal Pradesh phone number, 9459334377
