THERE IS NO COMMISSIONER IN THE (SIC) AND STATE GOVERNMENT OF HIMACHAL PRADESH FAILED TO FOLLOW PROCESS FOR THE APPOINTMENTS, FOR ABOUT ONE YEARS OF THE VACANT SLOTS

It is not understood why the appropriate government taking no cognisance, as required for the appointments of the SCIC, and SIC in Himachal Pradesh where the existing institution of the Commission is in defunct position for about one years of the duration and theCommissuoners shall be appointed by the Governor on the recommendation of a Committee consisting of-- (1) the Chief Minister, who shall be the Chairperson of the Committee;(11) the leader of opposition in the legislative Assembly;and (111) a Cabinet Minister to be nominated by the Chief Minister and where leader of opposition in the legislative Assembly has not been recognised as such, the leader of the single largest group in opposition of the Government in the legislative Assembly shall be deemed to be the leader of the opposition. The SCIC and SIC, shall while enquiring into the matters, have the same powers, as are vested in a civil court while trying a suit under the code of Civil procedure, 1908,in respect of the following matters:-- Summoning and enforcing the attendance of persons and compel them to give oral or written evidence on oath and to produce the documents or things. (b) requiring the discovery and inspection of documents; (c) receiving evidence on affidavit;(d) requisitioning any public record or copies thereof from any court or office;(e) issuing summons for examination of witnesses or documents, and (f) any other matter which may be prescribed. Further more, during the inquiry of any complaint under this Act, examine any record to which this Act applies, which is under the control of the public authority, and no such record may be withheld from it on any grounds. As such the office of the SIC has in defunct position and status for about one years of duration and the appropriate Government taking no cognisance on the captioned subject required under sub section (3) of Section 12 of the RTI act, 2005 and the people facing problems because of this position of the vacant slots empowered under the code of civil procedures 1908 and the other official and officers of the Commission are idle, due to non compliance under sub section (3) of section 12 of the RTI act, 2005 :-- Er Fateh chand Guleria, Director RTI welfare Association registered number HPCD, 3552 , Bilaspur Himachal Pradesh phone number, 9459334377
