APPLICANT WOULD BE PROVIDED FREE OF COST INFORMATION, IF THE CPIO FAILS TO GIVE DECISION ON THE REQUEST FOR INFORMATION WITH IN THE PRESCRIBED PERIOD

It is a matter of fact and concern to be taken into consideration by the department of language and culture, Government of Himachal Pradesh Kasumpti a, Shimla 9 where an Online RTI referred under section 6(3) by the Government of India department of culture to state Government of Himachal Pradesh and delay and dereliction of duty occurred at the level of the CPIO, one who has ignored basic concept of the RTI Act, 2005 and forcibly delayed the compliance under section 6(3) for which CPIO is responsible under law code manual prefixed by the code for consideration and explained as below " If the CPIO fails to give decision on the request for information within the prescribed period, the Central public Information officer shall be deemed to have refused the request. It is pertinent to note that if a public authority fails to comply with the specified time -limits, the information to the concerned Applicant would have to be provided free of charge. " Keeping in view the above guidelines the CPIO, Government of India is responsible to delay and dereliction of duty and Applicant may not be held responsible for any payment on account of additional fee and the payment of fee by the Applicant.
