STATE INFORMATION COMMISSION IDLE, BECAUSE OF NO SIC AND SCIC IN THE POWERS, VESTED IN A CIVIL COURT WHILE TRYING A SUIT UNDER, THE CODE OF CIVIL PROCEDURE, 1908.

Appropriate government failed to appoint SIC and the SCIC in State Information Commission for last about one year and the people facing problems because of non compliance at the levels of SIC, found necessary for complaints and the second Appeal, list by way and virtue of which the objective of the Right to Information Act, 2005 becoming un effective and an elaborate institutional mechanism has been destroyed by the functioning of the government taking no cognisance of the section 19(6) of the Right to Information Act, working for the timely action and correction as required for decision making, under the RTI Act, as a quasi judical function, where in it is found necessary that the appellate authority should see to it that the justice is not only done but it should also appear to have been done. In order to do so, the order passed by the appellate authority should be a speaking order giving justification for the decision arrived at. It is particularly mentioned here that the SIC is in defunct status and position since long and the public Information officers are taking no cognisance of the order of his Superior (FAA) and the applicants suffering because of non compliance at the levels of the public information officers. Further it is submitted in the matter that, if in any case, the public information officer doesn't implement the order passed by the appellate authority and appellate authority feels that intervention of higher authority is required to get his order implemented, he should bring the matter to the notice of the officer in the public authority competent to take action against the public information officer and such competent officer shall take action against the non compliance but it is regretted to point out that the Chief Engineer HPPWD Hamirpur failed to take action against the such complaint referred to his office by the Chief Minister office through Head of the department vide number 6899-6900 dated 18-12-2024 and the section 19(6)of the Right to Information Act kept pending without any enquire into the matter and on the other hand the SIC is defunct and appropriate government failed to appoint SIC and SCIC under sub section (3) of section 12 for which the High Court has also been apprised for the needful action but there is no follow up action neither at the levels of the appropriate government nor the High Court authority taking action for necessary appointments in the interest of general public, being responsible for the such delay and dereliction of duty :-- Er Fateh chand Guleria, Director RTI welfare Association registered number HPCD, 3552 , Bilaspur Himachal pradesh phone number, 9459334377
