PUBLIC PRIVATE PARTNERSHIP (PPP) AND INFORMATION RELATING TO PPP AND THE CITIZENS CHARTER PERFORMANCE AGAINST THE BENCHMARKS, SET IN THE CITIZENS CHARTER
RTI activists and volunteers are taking cognisance of the Citizens charter prepared by the Ministry/department, as part of the result framework document of the department/organisation under PPP and should be proactively disclosed and six monthly report on the performance against the bench marks set in the citizens charter should also be displayed on the website of the public authorities. Further more, if public services are proposed to be provided through a public private partnership (PPP) , all information relating to the PPPs must be disclosed in the public domain by the public authorities entering into the PPP contract/concession agreement. This may include details of the Special purpose vehicle (SPV) if any set up, details project reports, concession agreements, operation and maintenance manuals and other documents generated as part of the Implementation of the PPP project. The documents under the ambit of the exemption from disclosure of information under section 8(1) (d) and 8(1) (j) of the RTI act would not be disclosed suo motu. Further, information about fees, tolls or other kinds of revenue that may be collected under authorisation from the Government, information in respect of outputs and outcomes, process of selection of the private sector party may also be proactively disclosed. All payments made under the PPP project may also be disclosed in a periodic manner along with the purpose of making such payment. It should be the endeavor of all public authorities that all entitlements to citizens and all transactions between the citizens and the Government are gradually made available, as the departments reorganize their systems and processes to enable themselves for electronics service delivery, it is recommended that the requirements of bringing due transparency as provided in the RTI Act is given adequate consideration at the design stage itself. THE ROLE OF CIVIL SOCIETIES AND THE RTI ACTIVISTS AS WELL AS VOLUNTEERS AND RESOURCE PERSONS TAKING COGNISANCE OF THE RETENTION AND MAINTENANCE OF SPECIFIC DOCUMENTS AND DOING NEEDFUL, WHERE NECESSARY UNDER RTI LAW
The role of the civil society's people in the democracy of our country is more important, where they are also responsible to protect the fundamental rights of the citizen's charter for which the right to information empowered by the parliamentary democracy of our country, but it is regretted to point that very few people are taking cognisance of the said Act and conduct, related to the law code manual prefixed by the Constitution of India, in this behalf, however it is necessary to watch and ward the process created for laying down norms of performance for the major functions and required for monitoring as well as achievements , against those standards of the democracy for the people by the people and to the people. Detailing and describing the processes by which the general public can access and/or receive the goods and services that they are entitled to, from the public authorities/office, too describing the conditions, criteria and the priorities under which a person becomes eligible for the goods and the services and consequently the categories of people who are entitled to receive the goods and the services. Laying down individuals responsibility for providing the goods and services and implementation and responsible for the supervision. The powers of each officer including powers of supervision over subordinates involved in the chain of decision making, should be identified in the form of a flow chart explaining the rank /grade of the public functionaries, as related to the good governance and involved in the decision making process and the specific stages in the decision making hierarchy. On the other hand the political participation refers to the involvement in election related activities, such as attending campaign meetings and rallies, taking part in processions and participation in door to door canvassing, distributing election pamphlets and putting up their posters and sharing the campaign messages of political parties or candidates on platforms, working for their wining schedule for success in their vision power corridor. Keeping in view the difference of opinion, the civil society people must do their duty and follow transparency and accountability under law code manual prefixed by the Constitution of India in this behalf where the role of the RTI activists and volunteers carry more and more charities for any further review and revision of the documentary evidences and it is necessary for the good governance and charters of public accountability, so it is necessary to educate the citizens about the information/documents available to them and to provide printed publications to the citizens the categories of information that are frequently being sought under the RTI Act based on the RTI Rules, 2012 .
Keeping in view the above records and documents and their need based necessitated necesdity for the transparency in administration required to compile in relation to fiduciary related disclosure of the retention and maintenance of the specific documents for specified duration public authorities are held too responsible in this behalf of the serving RTI applications under effective system to redress the grievances of affected persons for which the RTI welfare Association and groups are working to deal with the public welfare promptly and taking compliance of the access to information procedure and awareness required for the education of the demand under public service utility, which is more important under present circumstances of the professional Upgradation of strengthening implementation required to be challenged before the FAA and SIC or CIC as the case may be, failing which it is not possible to bring transparency and charter of citizens welfare Association, hence the role of our democracy too related to the monitoring and reporting, but it is regretted for the non compliance at higher levels of the government functions for which civil societies must come forward and do needful in the interest of justice to common man demanding free and fair justice from the system of governance and recommendations for the reforms and amendment to this Act or other legislation or common law or any other matter relevant for operationalizing the right to access information, which are vital to it's functioning and also to contain corruption and to hold Governments and their instrumentalities accountable to the governed:-- Er Fateh chand Guleria, Director RTI welfare Association registered number HPCD, 3552 , Bilaspur Himachal pradesh phone number, 9459334377
CITIZENS CHARTER, PART OF RESULT FRAME WORK DOCUMENT SHOULD BE PROACTIVELY DISCLOSED, AND SIX MONTHLY REPORT ON THE PERFORMANCE AGAINST THE BENCH MARKS SET IN CITIZENS CHARTER SHOULD ALSO BE DISPLAYED.
It is very difficult to have access to information under the provision made and related to the public private partnership, however it is necessary in the cases of public private partnership (PPP) mode regarding to disclosure of the information, in the public domain by the public authority entering into the PPP contract/concession agreement. As far as transfer policy for different grades/cadres of employees serving in public authority is concerned, it should be proactively disclosed. All transfer orders should be publicised through the website or in any other manner listed in Section 4(4) of the Act. These guidelines would not be applicable in cases of transfers made keeping in view sovereignty, integrity, security, strategic, scientific or economic interests of the State and the exemptions covered under section 8 of the Act. These instructions would not apply to security and intelligence organisations under the second schedule of the RTI Act, 2005 . PUBLIC AUTHORITIES ARE RESPONSIBLE TO FOLLOW CITIZENS CHARTER AND DECIDE THE PENDING CASES ACCORDINGLY
It has become fundamental right of the every citizen of country since 2005 to follow empowerment delivered by the constitution of India and enquire into the matter regarding to the demand under public utilities and related to the RTI act publications for which Common man of the society and circle may have appropriate look and observation however very few number of people are taking interest in the RTI act publications by way and virtue of which some RTI welfare associations and unions as well as groups are working on the captioned subject matter deliberation noticed by the study of impact assessment realised by the resource persons and the group of identity.The awareness drive is main objective of the RTI act publications for which number of online programming and digital platforms have been made functional by the National compaign committee working for the good governance and charter of public accountability since the lock down period started by the government .The government is too responsible to aware the people of country for demand under public utilities so that necessary good governance and charter of public accountability may be obtained by the people of country demanding free and fair justice from the system of governance.If the public authorities are not taking interest in the awareness drive it is wrong and against the natural justice as such the public authorities and the government is responsible to protect fundamental rights of the Citizens however violation of empowerment is a serious concern and the government must follow Citizens charter under the law code manual and enforce penalty proceedings against the defaulters responsible for the good governance and accountability in the administration being deputed for the duty under law code manual of the work and conduct prefixed by the CCS& CCA rules -1965 but in the contrary RTI welfare associations are facing problems due to wrong interpretation of the law code manual even though the delay has been taken very serious concern by the act ibid however there is no consideration of the section 18 to 20 at the level of the SIC or CIC even number of cases are lying pending with the SIC and CIC for which online digital Schedule of hearings must be furnished and provided to the Citizens of country
