PEOPLE FACING PROBLEMS IN ACCESS TO INFORMATION UNDER SUB -SECTION (3) OF SECTION 12 OF RIGHT TO INFORMATION ACT, 2005 AND THE SIC IN DEFUNCT POSITION AND STATUS OF DESIGNATED OFFICERS
It has been noticed by the DoP&T memo number 1/34/2013-IR dated 29th June, 2015 that recommendations made by fiduciary disclosure of the service matters, the information relating to recruitment, promotion and transfers should be brought into public domain promptly, in order to reduce the number of RTI applications and minimize the burden of the servicing RTI applications, where in the public authorities with high public dealings should put in place an effective system to redress the grievances of affected persons. At the sub - organisation levels, and there should be cooperation and coordination between the Public Information officers and the officers responsible for addressing public grievances for which all the public authorities are held responsible to follow the above guidelines and related to fiduciary disclosure of training modules required for professional upgradation of employees and should incorporate transparency and open government implementation under RTI Laws , however it is regretted to point out that the public information officer cum Engineer officer 10 th circle HPPWD Bilaspur taking no cognisance of the order passed by FAA cum Superintending Engineer HPPWD Bilaspur Himachal Pradesh in Apoeal number 12/2023 dated 30-1-2024 even clear decision on the captioned subject matter deliberation required to be followed under section 19(6) of RTI, Issued free of cost to appellant but it is regretted for the non compliance where in neither FAA himself supplied the fudiciary related information to appellant nor the Public Information Officer doing needful in the matter for which the order passed by honourable CIC issued vide number CIC / CAGIN / A /2024 /100474 dated 3-6-2025 yet pending for communication gap prefixed by the Central Information Commissioner inter alia taking positive measures to strengthen implementation of the recommendations made by the pay commission report issued vide number Fin (PR) B (7) -1/2021 dated 3-1-2022 but non compliance of CE (MZ) number 17443 dated 1-11-2018 and CE (HZ) number 13079 dated 1-2-2023 still pending before the disciplinary authority and the public information officer failed to issue point wise reply of Administrative reforms memo (4-10-2023) hence liable for disciplinary action since instructions issued vide number Per (AP-B) B-(11) -2/2004 -16 dated 3-12-2014 and the appellant is facing undue victimisation due to non compliance and wrong deal and delay in information is proof and evidence on record for which the appropriate government taking no cognisance to make SIC functional one as declared defunct because of the retirement of both, SIC and SCIC for which number of requests made before the honourable Chief Minister of the state government and the Governor for taking cognisance under sub section (3) of section 12 of the RTI act, 2005 however there is no appointment for the designated officers required for the Second Appeals and complaints under law code manual prefixed by the Constitution of India in this behalf:-- Er Fateh chand Guleria, Director RTI welfare Association registered number HPCD, 3552 , Bilaspur Himachal Pradesh phone number, 9459334377
