VIOLATION OF THE SPIRIT OF ACT ISSUED FOR DUE PROMOTION OF DIPLOMA ENGINEER UNDER (ACPS) YET ENFORCED BY HPPWD EVEN CLEAR INSTRUCTIONS OF THE ADMINISTRATIVE REFORMS ORGANIZATION WORKING FOR THE GOOD GOVERNANCE AND TRANSPARENCY IN ADMININISTRATION IS PROOF AND EVIDENCE ON THE RECORD.

It is a matter of fact and concern to be noticed by the department of HPPWD that former cases of ACPS particularly issued to the junior Engineers in lieu of due benefits of promotion on 3-10-1991 with designated post EAE and XEN required to be preferred in the second channels of promotion being senior in rank and grade than others joining the cadre of AEs have yet no cognizance and report asked as by the department of HP finance on 3-1-2022 with the clarification that increments of the senior government employees should have not been withheld/stopped by way of penalty or otherwise and the option once exercised would be considered final and irrevocable one ,however instead of releasing the due benefits of cadre/grade / post concerned the disciplinary authority compulsory retired the functional post demanding application of rule 10(5)(c) of CCS &CCA Rules 1965 in the case file where in it is clearly mentioned that" In appeal and represention the order is modified into one other than,dismissal ,removal or compulsory retirement and no further enquiry is ordered to be held" but it is regretted to point that the disciplinary ignored the departmental proceedings and too the law code manual prefixed by the HP finance and personnel and again enforced enquiry and chargesheet for removal of higher post and grade encadred for the due benefits with reorganization Act and guidelines issued by the government and Department of the Finance and Personnel and clear violation of the spirit of status and seniority of the cadre /grade /post deleted for which the disciplinary authority may be held responsible to ignorance of the Act and advice of the competent higher authority but nothing concrete has been done so for in the pending cases even over due for monthly statement of cases pending finalisation over 3 months since pay commission report issued by the government vide number Fin (PR) B -(7)-1/2021 dated 3-1-2022 is proof and evidence on the record and the department of Administrative reforms too asking for the conclusion and correction of wrong interpretation of law code manual prefixed by the HP finance and personnel but departmental proceedings yet deleted for the action taken report and compliance under the provision made ACPS to regular Employees of the government demanding at par with junior cadres like draftsman too promoted in the joint cadre during 1-1-86 onwards and for which there is no reason to delete and deny the claims of seniority by the Diploma cadre /grade /post being eligible for the promotion preferred in the second channels for gaining at par seniority with the junior cadres .
