STATE GOVERNMENT OF HIMACHAL PRADESH TAKING NO COGNISANCE UNDER SUB -SECTION (3) OF SECTION 12 AND THE (SIC) STILL WITHOUT ANY COMMISSIONER, FOR LAST ABOUT ONE YEAR

It is not understood how the present state government working for the welfare of society and circle, under the circumstances when there is no Commissioner and the Chief Information Commissioner since for the last about one year of duration, even though the Information commissioner, after the end of each year, are required to prepare reports on the implementation of the provision of the Act during that year. Each Ministry or department is required, in relation to the public authorities within its jurisdiction, to collect and provide information to the concerned information Commission for preparation of the report. The report of the Commission, inter alia, contains following information in respect of the year to which the report relates:-- (a) the number of requests made to each public authority (b) the number of decisions where applicants were not entitled to access to the documents pursuant to the requests, the provisions of the Act under which these decisions were made and the number of times such provisions were invoked. (c) particulars of any disciplinary action taken against any officer in respect of the administration of the Act (d) the amount of charges collected by each public authority under the Act, and (e) any facts which indicate an effort by the public authorities to administer and implement the spirit and intention of the Act. Keeping in view the delay and dereliction of duty, no practice of public authorities, in relation to the exercise of its functions under the Act conforming with this provision, or spirit of the Act, it may appoint designated Commissioners for the required steps ought to be taken under sub section (3) and Section 12 of the Right to Information Act, 2005 and people facing problems because of the delay and the RTI Annual Report Information System has been locked, even it is unloaded for the above reports on quarterly basis:-- Er Fateh chand Guleria, Director RTI welfare Association registered number HPCD, 3552 , Bilaspur Himachal Pradesh phone number, 9459334377
