DEPARTMENT OF PUBLIC WORKS HIMACHAL PRADESH TAKING NO COGNISANCE OF THE CADRE SPECIFIC POST ISSUED TO JUNIOR ENGINEER AFTER 18 YEARS OF REGULAR SERVICE AND ENFORCING WRONG ASSESSMENT BY IGNORING THE ADVICE OF LAW, FINANCE, PERSONNEL AND THE ADMINISTRATIVE REFORMS ORGANIZATION, WORKING IN THIS BEHALF OF THE ADVICE FOR CONCLUSION OF CASES OF THE DYNAMIC ACPS

Post of junior Engineer in the department of public Works Himachal Pradesh was upgraded to higher level of promotion with designation Extra Assistant Engineer on 3-10-1991 for cadre specific grant under dynamic Assured Career Progression for which department of Finance and the Personnel issued provision of the addition made under dynamic ACPS on 16-8-2000 for due benefit of the FR-22 but it is regretted to point that department of public works taking no cognisance of the instructions and guidelines on captioned subject issued by the department of Administrative reforms and enforcing wrong assessment of the ACPS even clear vision of the pay commission report so issued on 3-1-2022 is proof and evidence, where in it is clearly mentioned that increments of the senior Government employees should have not been stopped/withheld by way of penalty or otherwise and option would be considered final and irrevocable one but the disciplinary authority taking no cognisance on the issue and matter and in the contrary RTI application too kept pending for information under section 19(6) of the RTI act, 2005 by Public information officer and the FAA even responsible for decision making under quasi -judicial function, where in it is necessary for the FAA to see that the justice is not only done, but it should appear to have been done. In order to do so, the order passed by the appellate authority should be a speaking order giving justification for the decision arrived at, and for which the FAA has already issued directions to the Public information officer cum EO to release free of cost information to appellant vide his appeal number 12/2023 dated 30-1-2024 but the public information officer taking no cognisance of the directions of the appellate authority since again as application filed before the public information officer on 11-4-2025 however the public information officer again demanding a sum of rupee 107/ from the appellant for said information which has been allowed free of cost by his commanding officer since 30-1-2024 more over a period of more than three month have elapsed since 11-4-2025 but the Public information officer taking no action as per directions of the FAA even complaints before the SIC and the honourable Chief Minister and Secretary Vidhan Sabha is proof and evidence for disciplinary action against the public information officer and FAA , under these circumstance it is becoming difficult to obtain the required informations even clear vision of the FAA as under:--CONCLUSION:" -- In view of the above and from the records produced, it is clear that what ever information on point number 1,3,4and 5 was not provided to applicant, The public information officer cum Engineer officer 10 th Circle HPPWD Bilaspur is directed to supply the reply in respect of point number 1,3,4 and 5 to the appellant free of cost on or before 10-02 -2024 "Accordingly the appeal is finally disposed off:-- Er Fateh chand Guleria, RTI welfare Association registered number HPCD, 3552 , Bilaspur Himachal Pradesh phone number 9459334377
