GOVERNMENT OF INDIA'S DECISION, RELATED TO CONTACT WITH THE GOVERNMENT, RESPONSIBLE FOR THE PROSECUTION OF CRIMINAL CASES, AND INSTRUCTIONS IN THE DISPUTES
The right to information is simplicity guaranteed by the constitution of India. However, with a view to set out a practical regime for the citizens to secure information as a matter of right, the Indian parliament enacted the Right to information Act, 2005 . This law is very comprehensive and covers almost all matters of governance. This law has a wide reach, being applicable to Government at all levels-- Union, state and local self Government as well as to the recipients of substantial Government funds. Government activities has become so vast and so diverse that there is hardly any area where the common man doesn't come into contact with Government. The contact may be direct, in the form of Government services, Government tax and revenue collection or Governments land administration system or it may be indirect, in the form of rules and Acts which regulates transactions even between private citizens or organisations. It is natural therefore that resolution of disputes arising from various transactions tend to involve the Government either central, State or local self government and in fact, Government is the biggest litigant.As such it is obligatory for all the public authorities under clause (c) of sub section (1) of section 4 of the Act to publish all relevant facts while formulating important policies and announcing decisions affecting the public. They under clause (d) are also obliged to provide reasons for their administrative or quasi -judicial decisions to the affected parties. Section 4 of the RTI Act requires wide dissemination of every information required to be disclosed suo motu in such form and manner which is accessible to the public.
