EARLIER EXECUTIVE ENGINEERS OF THE PUBLIC WORKS AND THE DIVISIONAL FOREST OFFICERS OF THE FOREST DEPARTMENT HAVE THE SAME POWERS AS ARE VESTED IN A CIVIL COURT, HOWEVER AT PRESENT NO OFFICERS ARE TRYING THE SAID SUITS, AND NUMBER OF COMPLAINTS ARE PENDING BEFORE THE DEPARTMENTS

Earlier the Executive Engineers of the Public Works department and the Divisional Forest Officers of the forest department , while enquiring into any matter have the same powers, as are vested in a civil Court while trying a suit, under the code of civil procedure, in respect of the following matters (1) Summoning and enforcing the attendance of persons and compel them to give oral or written evidence on oath and to produce the documents or things before the competent authority for decision making in this behalf of the preliminary complaints before the department. (2) Requiring the discovery and inspection of documents (3) Receiving evidence on affidavit (4) Requisitioning any public record or copies thereof from any court or office (5) Issuing Summons for examination of witnesses or documents and (6) Any other matter which may be prescribed. Nowadays no said officers are taking cognisance of the enquiring into the such matters and the only Sub Divisional officers (civil) are doing needful under the provision made, as are vested in a civil court while trying a suit under the code of civil procedure and cases related to such complaints before the department concerned are kept pending without any required decision and conclusion of the captioned subject matter deliberation is under the control of the said office and authority and no such record may be kept pending without taking cognisance of the demand under public utility/services maintained by the Government for the welfare of the general public, facing problems because of the sufficient cause of action against the culprits doing wrong and misusing the Government properties and destroying the original witnesses and documents by way such activities against the public interest for which the public may take issue and matter before the Competent higher authority for doing needful under law code manual prefixed by the code for consideration by each public authority in this behalf of the demand under public utility services for the penal action and other remedial measures against the culprits, so verified by the said public authorities in this behalf of the enquiry before the office and Authority:-- Er Fateh chand Guleria, RTI welfare Association registered number HPCD, 3552 , Bilaspur Himachal Pradesh phone number, 9459334377
