Yet corruption and dilution remain major blocks in effective delivery of the programmes. Only a percentage of the intended benefits reach the targetted poor. Often the poor are not even aware of the objectives of the programmes. In order that a change can be brought in the present state of affairs it is essential that there is a greater participation of the primary stake holders in the various stages of the decision making and implementation of the programme. The poor people and also educated youth and other active members of the village community must be fully aware of the Government schemes and programmes meant for their progress. There must be growing awareness of their rights and entitlements. With information and knowledge they must learn to question rationally. GHUMARWIN SUNHANI ROAD MUST BE ENSURED FOR THE SAFE ALIGNMENT OF HILL ROAD , AS IT IS YET IMPRACTICABLE TO GET OVERTAKING SIGHT DISTANCE AT NUMBER OF PLACES, EVEN COVERED UNDER THE JURISDICTION OF TWO DIVISIONS OF THE PUBLIC WORKS DEPARTMENT
During the recent heavy rains the Major District Road Ghumarwin to Berthin -Talai (portion Ghumarwin to Sunhani) remained close for the essential repairs of the damages but it is regretted to point out that the seven number identified sites of the heavy slips and steep cross sectional elevations of the road damages are still required to be improved by the department, where the road width is not widened up to the required width of the portion of the existing road and the buses and other vehicular traffic going on the said road more over there is a cavity on the portion of road crust used by the vehicular traffic near ahead from village Badi and almost very near to the Nalu where a forest department nursery was maintained by the department of forest however the said cavity is not appeared in the vision of driver eyes during the course of driving over the inner curve of that portion where the road seems to be very dangerous, but not maintained for the safe visibility distance, where it should not be ignored by the department that driver's visual difficulty is magnified by hazy visibility during the rains, and the existing cavity is below the road crust, where it is not possible to protect the vision of the eye distance and the curve is existing on the inner side of the alignment of hill road and there is no possibility of visibility up to the minimum stopping sight distance all along it's length. Mahatma Gandhi National Rural Employment Guarantee Scheme and Act for the village community people working for the rural areas of the country and doing needful under the provision made for implementation and completion of the works under the schemes for development and livelihood of the households registered itself with the panchayat for employment. All the institutions that exist in the village must create awareness among the people about the National Employment Guarantee Act/scheme by taking to them about it . They must encourage all those who seek continuous employment and see it that they apply and get job cards. They should work towards ensuring that such job card holders get work within 15 days of applying for employment. They must help towards seeing that all the wage seekers open post office accounts/bank accounts. After the wages have been sanctioned by the programme officer, they must inform the workers in a manner that they may receive their wages. They must create complete awareness regarding those components on which there can be no compromise, the rights of workers, labourers, facilities, due to them. It has become general tendency of the public authorities regarding to deny RTI information on the basis of review and simple justification with the reply that such information is not available in the record of their office data and report and returns of the time to time issued existing conformations of the department and the office. It is very clear to say that correct decision making depends upon the accuracy of the information on which the decision is based. Accordingly it is very important to identify the information that is often required, the sources and the frequency with which the information must be updated. For this purpose reports and returns are specified with proforma giving the specification of each item of the data. Systematic decision making is possible only if the reports and the returns are properly specified, they are obtained or sent as required and must be compiled and interpreted efficiently in the interest of efficiency in administration and correct decision making. It is very clear from the above mentioned clarification that a periodical review of reports and returns should, therefore, be conducted and for this purpose a time bound programme should be drawn up, where in it is too necessary to follow an inventory of all daily, weekly, fortnightly, monthly, quarterly, half yearly and yearly reports and returns of the department and thereafter the review should be carried out in accordance with the procedure laid. NATIONAL HIGHWAY AUTHORITY OF INDIA SHOULD FOLLOW DESIGN PARAMETERS FOR HILL ROADS AND SIDE SLOPES OF CUTTING, BASED ON THE CLASSIFICATION OF SOILS, AND DECIDE SHAPE, SIZE AND CARRIAGE WAY OF ROAD WIDTH ACCORDINGLY
Hill state construction of roads based on recommended standards for the rural highways are presently reduced by the National Highway Authority of India to 5.5 metre from the old existing standard of 7.00 metres for two lane without kerbs as per the circular of the National highway authority of India issued on March 23 , 2018 keeping in view the ecological issues related to the mountainous areas of the roads for which the four lane standard of roads should also be made on the similar standards of the minimum width of the existing carriage way. On the other hand, the width of the village roads carriage way has been considered 3.00 metres and the major district roads 3.75 metres but it is not properly maintained by the department of public Works where the encroachments are forcibly used by the people and department taking no cognisance to remove such hurdles of the routine traffic and the foot paths for the use of common man even the places kept for the bus stops are too covered by the people of boundary line required right of way, where the minimum set back for building line should be 5 metre in the normal cases and 3.00 m in the exceptional circumstances and the additional land may be acquired at locations involving deep cuts, high fills and unstable or landslide areas. The full roadway width should be carried through on the culverts, scuppers and the cause ways, as per design considerations of the road curvature based on the hill roads. As far as efficiency in administration is concerned, at present there is no check on the final disposal of references, where in it is also necessary that in many cases back references may have to be made from time to time delaying the final action in cases, It is therefore essential that whatever information is wanting in a case should be asked for in the first back reference and there should normally be no need to make further back reference. CONSTITUTIONAL POSITION OF FUNDAMENTAL RULES RELATED TO GOVERNMENT SERVANTS, UNDER ARTICLE 19(1) OF THE CONSTITUTION AND EXPLANATION MADE BY THE, CCS(CONDUCT) RULES:-
Conduct of Government servants, under proviso to Article 309 of the constitutional provides for rules regulating the recruitment and conditions of service of persons appointed to Government services and posts, Accordingly the rights provided in Article 19(1) of the Constitution are also subject to reasonable restrictions, if any, imposed under the rules framed under proviso to Article 309 of the Constitution, in so far as the Government servants are concerned. (Conduct) Rules:- The centre civil services (Conduct) Rules, 1964 impose various restrictions on the rights conferred by Article 19(1) of the Constitution in so far as the Government servants are concerned. Important provisions of the Central Civil Services (Conduct) Rules, 1964 which impose such reasonable restrictions are under for the guidance, if any:-- (1) Rule 6 forbids Government servants from joining, or continuing to be a member of, an association the object or activities of which are prejudicial to the interest of the sovereignty and integrity of India, or public order or morality (2) Rule 7 provides that no Government servant shall engage himself or participate in any demonstration, which is prejudicial to the interests of the sovereignty and integrity of India, the Security of the State, friendly relations with foreign States, public order, decency or morality or which involves contempt of court, defamation or incitement to an offence. Further no Government servant can resort to or in any way abet any form of strike or coercion or physical duress in connection with any matter pertaining to his service or the service of any other Government servant. As per explanation below F. R. 17-A, Strike includes a general, token, sympathetic or any similar strike and also participation in a bundh or in similar activities. accordingly , the right to form associations/unions as contained in the Constitution does not empower government servants to resort to strike or to other activities which are forbidden by the Conduct Rules. THE DESIGN OF GUIDELINES FOR SECTION 4, SHOULD BE EXTENDED TO COVER ALL STATUTORY AND DISCRETIONARY OPERATIONS, EXPLAINING THE RANK /GRADE OF THE PUBLIC FUNCTIONARIES INVOLVED IN THE DECISION MAKING.
The procedure followed in the decision-making processes under the RTI Act, 2005 including channels of supervision and accountability under section 4(1) (b) (111) the guidelines for detaining below must have identification by the every public authority related to major outputs/tangible results/services/goods, as applicable, that it is responsibility for providing to who so ever is the client of the public authority. GOVERNMENT IS RESPONSIBLE TO CONSIDER NATURAL CALAMITY OF THE BUS ACCIDENT CASUALTIES AND DECIDE MATTER IN THE INTEREST OF JUSTICE TO ALL CONCERNED IN THE PROBLEM, BECAUSE OF HEAVY RAIN AND THE HYDROSTATIC PRESSURE ON THE VERTICAL CLIFF (SOFT ROCK) FAILED TO RESIST SAID CALAMITY HELD ON 7-10-2025 , AT THE MOMENT.
It is a matter of fact and concern that the Sukker khud bridge has been working since 1981-82 regularly for the scheduled vehicular traffic on the said road from Talai to Ghumarwin and the portion of accidental site where the administration taking cognisance of the reasons for this mis happening and the casualties occured was definitely a soft rock and a vertical cliff, however it could not be considered a gravity wall by the administration and the engineering department working for the safety measures of the said site for the future course of routine vehicular traffic, more over it is also fact that said vertical cliff (soft rock) never came down during the rainy season since this bridge has been commissioned by the department of public Works, list by way and virtue of which it is clear that the existing slopes of the vertical cliff remained stable during this period of the vehicular traffic on said road at this place of the accident occurred on 7-10-2025 . Further it is mentioned in the held discussion on the captioned subject of public grievances related to the reasons for verification of the facts observed by the department of HPPWD, Administration and the police authorities too responsible for the identification of black spots, that in the cases of heavy Retaining walls weep holes with pocket drains are also maintained by the construction agencies in this behalf of the rescue for hydrostatic pressure in addition to pressure exerted by the submerged soil, as such surface or underground water may seep into backfill and this may cause hydrostatic pressure and in such cases Retaining walls are designed for the earth pressure and also for hydrostatic pressure. Keeping in view the above considerations of the existing structure of vertical cliff at this point of the accident held on 7-10-2025 it is very clear that department of Public Works may not held responsible for the sudden collapse of said portion of the vertical cliff came down heavily during this accident and because of the increase of the water contents in the exerted earth failed to resist the hydrostatic pressure of the rain and top hill profile of the mountain where no drainage system exists and the top land may belong to the private land owners. HOW TO MAINTAIN PROBABILITY FACTOR OF THE RTI AND RTS ACT ADJUDICATION STABLE IS BECOMING A QUESTION OF THE VIOLATION OF FUNDAMENTAL RIGHTS
It is a matter of fact and concern to be notice the degree of probability factor of the transparency and accountability and the charter of public accountability required for the good governance and control of the public authorities under purview of the work and conduct including the efficient operation of the Governments, optimum use of limited fiscal resources and the preservation of confidentiality of sensitive information. DUE TO INCREASE IN THE WATER CONTENTS OF A VERTICAL CLIFF (SOFT ROCK) THE ANGLE OF REPOSE FAILED TO RESIST THE INTERNAL FRICTION OF GRANULAR SOILS.
Various systems of classifying soils for civil engineering purposes have been devised and the use of different systems has led to much confusion. The course grained soils are usually classified mainly on the basis of their particle size distribution and the fine grained soils on the basis of their plasticity characteristics. The two most widely used systems of soil classification are those of public road administration and of chemical composition. There is wide variation in the characteristics of different soils and the performance of each individual soil is affected by its moisture content and the density . In general the properties of the soils composed largely of course materials are primarily controlled by the characteristics of the particles, but for soils composed largely of clays and colloids the properties are primarily controlled by the moisture content. Behavior of soils containing 30 percent or more clay depends solely on the characteristics of the clay. It is particularly mentioned here that the soft rock existing in the vertical cliff where the bus accident took place in Sukker Khud bridge on 7-10-2025 at about 6 pm and eighteen dead bodies recovered by the administration and the police authorities, so happened because of the increase of water contents in the soil (soft rock) due to unstable position of the angle of repose at that particular place, came down heavily at the moment when that bus was crossing at that particular place and there was no chance to back the bus and have rescue on the tragedy occurred because of the sudden land slide. The site was in person visited by me on 8-10-2025 at 8-30 am and too at the time of evening at 3-30 pm when the road was opened for the vehicular traffic by the HPPWD authorities working day and night at the site for rescue operation along with heavy machinery and infrastructure for the recovery of site to safe vehicular traffic, where said accident took place because of the sudden land slide on the bus body where 18 casualties have been reported by the administration and the entire administration was present at the site of work when the local Minister of the Bilaspur district Shri Rajesh Dharmani visited the place of accident and verify the situation at the site of work, Shri jeet Singh Thakur Superintending Engineer HPPWD Bilaspur issued necessary instructions to the department of HPPWD to improve the entire area of dangerous profile existing slopes and the fractured soft rocks and open it to traffic after the needful under these instructions of the Engineering department the Executive Engineer Jhandutta Division took cognisance and made it fit for the vehicular traffic at about 3-30 pm, in the presence of the local people and the administration, working for the welfare of the society and circle and doing needful since this mis-happening :-- Er Fateh chand Guleria, Director RTI welfare Association registered number HPCD, 3552 , Bilaspur Himachal Pradesh phone number, 9459334377
TIME HAS COME TO FOLLOW CHALLENGE GIVEN BY THE FORMER CHIEF MINISTER AND HAVE ELECTION FOR THE ADMINISTRATIVE REFORMS, INSTEAD OF PRACTICAL REGIME OF RTI AND THE RTS
Time is coming to accept the challenge of former Chief Minister of Himachal Pradesh, where in, it is warned to the Government employees and the retirees to fight election in the democracy and watch the after affects of the present system of democracy maintained by the government. It is very clear from the above statement of the former Chief Minister of the state that they are also feeling tired from the ongoing system of generated democracy for the public to the public and by the public. However the elected representatives of our parliamentary democracy may work and follow their path for the public welfare but at the same time, it is also necessary to have good governance and accountability in the system maintained by the Government and the popular government instead of the presidential type of the Government for public welfare. It is further submitted on the captioned subject that it is necessary in the system of our democracy to have implementation of the RTI and the RTS act in required administrative reforms of the demand under public service and utility for the access to information and removal of corruption as facing delays and dereliction of duty and there is no alternative except to follow the justice system of our democracy and the required administrative reforms, where our Supreme Court of India is also working on the captioned subject in addition to the parliamentary democracy and the administration, doing needful under law code manual prefixed by the Constitution of India in this behalf of the rendered service for the welfare of people of country, electing their representatives for the choice of democracy in the state of rules for the citizens of country and maintaining their vision as per day to day problems and present situation of the ongoing system of our financial support and reforms under law code manual prefixed by the Constitution of India in this behalf. PROTECT RTI AND RTS AND SAVE DEMOCRACY IN THE INTEREST OF JUSTICE FOR APPEALS AND COMPLAINTS
It is a matter of fact and concern that the RTI Act, 2005 and the RTS act, 2012 is becoming a routine matter of the public authorities instead of time bound schedule for implementation of the provision made and procedure laid for the good governance and accountability for which protect RTI and the RTS is a vision for save democracy and follow charter of public accountability under law code manual prefixed by the Constitution of India in this behalf as facing delay in routine and non compliance at the levels of Public information officers and the First appellate authorities, even though and moreover
, deciding appeals under the RTI act is a quasi judicial function, hence it is necessary that the appellate authority should see to it that the justice is not only done, but it should appear to have been done. In order to do so, the order passed by the appellate authority should be a speaking order giving justification for the decision arrived at. So in view to have above conclusion of the section 19(6) of the RTI act, 2005 , it is necessary for the FAA to satisfy the applicants being responsible for the information under his control, as such the SIC is responsible to follow delay and dereliction of duty and have compliance under section 18to 20 of the RTI act, 2005 where no penalties are followed by the system generated by the Government and now appointment of the Commissioners too delayed more than required for the review of cases under Second Appeals provision made for the removal of delays and correctness of the work and conduct of the government machinery for which it is necessary to follow the complaints and Appeals before FAA where the informations are provided by the public information officers and analysis of the work done concluded for the good governance and accountability is evidence for the procedure laid down under law code manual more over the working of Commissions within the time limit specified under law, has no response at the present and delays becoming a routine matter of the preferred Second appeal, it is therefore necessary to have correspondence under section 19(6) of the RTI act, 2005 before the FAA and demand justice or follow the Court of law for action against the non -compliance at the level of Commission:-- Er Fateh chand Guleria, Director RTI welfare Association registered number HPCD, 3552 , Bilaspur Himachal Pradesh phone number, 9459334377
