PROTECT RTI AND RTS AND SAVE DEMOCRACY IN THE INTEREST OF JUSTICE FOR APPEALS AND COMPLAINTS

It is a matter of fact and concern that the RTI Act, 2005 and the RTS act, 2012 is becoming a routine matter of the public authorities instead of time bound schedule for implementation of the provision made and procedure laid for the good governance and accountability for which protect RTI and the RTS is a vision for save democracy and follow charter of public accountability under law code manual prefixed by the Constitution of India in this behalf as facing delay in routine and non compliance at the levels of Public information officers and the First appellate authorities, even though and moreover
, deciding appeals under the RTI act is a quasi judicial function, hence it is necessary that the appellate authority should see to it that the justice is not only done, but it should appear to have been done. In order to do so, the order passed by the appellate authority should be a speaking order giving justification for the decision arrived at. So in view to have above conclusion of the section 19(6) of the RTI act, 2005 , it is necessary for the FAA to satisfy the applicants being responsible for the information under his control, as such the SIC is responsible to follow delay and dereliction of duty and have compliance under section 18to 20 of the RTI act, 2005 where no penalties are followed by the system generated by the Government and now appointment of the Commissioners too delayed more than required for the review of cases under Second Appeals provision made for the removal of delays and correctness of the work and conduct of the government machinery for which it is necessary to follow the complaints and Appeals before FAA where the informations are provided by the public information officers and analysis of the work done concluded for the good governance and accountability is evidence for the procedure laid down under law code manual more over the working of Commissions within the time limit specified under law, has no response at the present and delays becoming a routine matter of the preferred Second appeal, it is therefore necessary to have correspondence under section 19(6) of the RTI act, 2005 before the FAA and demand justice or follow the Court of law for action against the non -compliance at the level of Commission:-- Er Fateh chand Guleria, Director RTI welfare Association registered number HPCD, 3552 , Bilaspur Himachal Pradesh phone number, 9459334377
