JUSTICE DELAYED IS JUSTICE DENIED FOR WHICH THE GOVT IS RESPONSIBLE TO FOLLOW CORRIDOR REQUIRED FOR THE EARLY REFORMS.
In a judgement related to the findings of its earlier decision and judgement not complied with, the Himachal Pradesh High court has told the state government to stop tossing the file from one department to another Department ,as such only the sanction of Department of Finance is required necessity and that is obligatory not discriminatory,so there is no reason to involve other departments. Making it clear on the issue and matter that the state has no option but to comply with , the High court said failing which and otherwise,the official concerned will be prosecuted and punished for the contempt of court, if found guilty. The division bench of justice Tarlok Singh Chauhan and justice Chander Bhushan Barowalia said that the state had tried to assail the 2015 verdict in the case Parvati Sharma versus the state of HP,affirmed on January 11 ,2018 by the Supreme court. The state government has scrapped the tribunal during its tenure and now the Employees are facing problems and delay in deciding the cases for which the Employees are bound to follow High court of state under law code manual prefixed by the constitution of India or represent before the appropriate government under RTS act adjudication for pendency and grievances redressal Administrative reforms processed under law code manual since 2011 through the Department concerned and the Higher authority as well as the SIC empowered for the good governance and accountability in cases of RTS in addition to the RTI act publications where as in neighbouring state of Haryana a separate Commission is appointed by the government to follow charter of public accountability and transparency in the related cases of public service guarantee act-2012 , for which the government is too responsible to follow the pending representations of the such cases lying pending with the appropriate government and decide accordingly in the interest of justice to Common man demanding free and fair justice from the system of governance, or again start the HPAT to listen and resolve the problems of the Employees .
