WHAT A NEW DATA LAW MUST HAVE

Cross -border data flows enables the development of marketing,and the skilling of our work force in the modernization of technology and the cross border data flows also prevent the fragmentation of the internet .Several Indian companies have a borderless internet to thank for their global growth and mechanism as well as facilitation and for which the cross border data flows are crucial to their continued support and success. Several studies over the years have underscored why cross border data flows are critical to economies .India does not have a data protection law code manual yet and it does have a set of rules under the IT act that regulates how business use sensitive personal data ,but the rules have barely been enforced ,as such the new data law must establish a robust regulator.The regulator must work closely with the government authorities like RBI , Health,TRAI and other sectoral regulators.The RBI has already made inroads into the data governance, mandating local storage by way of processing queries and return replies on behalf of the Application,in network management system ,agents reside in all managed devices and report the values of specified variables to the management stations.As such it is expected to release more and more guidelines for digital lending plateforms, likely to extend the data collection and sharing its use and exercise in facilitation of the various Schemes and programmes issued by the government in this behalf like RTI act publications and too the RTS act adjudication required for the welfare of society and circle so that the data law should thus focus on ensuring regulatory coordination.
