THE DATA LAW SHOULD FOCUS ON CHECKS AND BALANCES ALLOWING AN INDIVIDUAL TO CONTROL THE INFORMATIONS .

The personal data is data which relates to the individual concerned,such as name ,phone number,credit details etc where as the non personal data is not related to the individual and general purposes of the informations and collection of data by the study made and created for the good governance and accountability under law code manual prefixed by the constitution of India in this behalf since the RTI act publications. Earlier about five years ago justice BN Shrikrishna Committee was asked to come up with a law to required to protect Personal data , related to the fundamental rights of the privacy of the individuals concerned. While the Committee's draft focused on personal data,GOI's 2019 version included non Personnel data .As such later on a Parliamentary Committee examining the law for personal and non personal data. Now therefore the objective to protect personal data has been diluted , while personal data protection is allowing an individual to control the information contained in personal capacity of the individuals character and ideology,used in personal capacity of the data details. On the other hand the law must minimise the amount of data collected by security agencies, limit how long it can be stored ,and require agencies to adopt security measures to safeguard the information. The privacy advocates have been calling for reforms of Indian surveillance laws ,however the data laws presents some opportunities to extend certain privacy principles to data processing by law inline with the fundamental rights of the privacy however every thing related to the person could not be considered as personal data for which description of law must be explained by the study of protocol mentioned in the RTI act publications clearly as facing problems to obtain the important informations. Wide exemptions-like the ones proposed by the now withdrawn bill , would also move us farther from any data ,adequacy arrangements which requires checks and balances on the government surveillance the democratic republic of country free allowing what a new data law must have to redraft the bill before allowing free flows of data to that country.
